{"id":5047,"date":"2025-11-07T09:01:01","date_gmt":"2025-11-07T08:01:01","guid":{"rendered":"https:\/\/dolezalpartners.com\/?p=5047"},"modified":"2025-11-07T09:01:34","modified_gmt":"2025-11-07T08:01:34","slug":"predstaveni-flexinovely-zakoniku-prace-2025-2","status":"publish","type":"post","link":"https:\/\/dolezalpartners.com\/sk\/predstaveni-flexinovely-zakoniku-prace-2025-2\/","title":{"rendered":"P\u0159edstaven\u00ed \u201eflexinovely\u201c z\u00e1kon\u00edku pr\u00e1ce 2025"},"content":{"rendered":"\n<p>N\u00e1sleduj\u00edc\u00ed text shrnuje podstatn\u00e9 zm\u011bny z\u00e1kon\u00edku pr\u00e1ce (d\u00e1le tak\u00e9 jako \u201e<strong>ZP<\/strong>\u201c) zaveden\u00e9 <strong>s&nbsp;\u00fa\u010dinnost\u00ed k&nbsp;01.06. 2025<\/strong> tzv. <strong>flexinovelou ZP<\/strong>, tedy z\u00e1konem \u010d. 120\/2025 Sb., kter\u00fdm se m\u011bn\u00ed ZP a n\u011bkter\u00e9 dal\u0161\u00ed p\u0159edpisy (d\u00e1le tak\u00e9 jako <strong>\u201eflexinovela<\/strong>\u201c \u010di <strong>\u201eflexibiln\u00ed novela\u201c<\/strong>).<\/p>\n\n\n\n<p>Ji\u017e z&nbsp;hovorov\u00e9ho pojmenov\u00e1n\u00ed dan\u00e9 novely je z\u0159ejm\u00e9, \u017ee tato c\u00edl\u00ed zejm\u00e9na na d\u00edl\u010d\u00ed rozvoln\u011bn\u00ed pracovn\u011bpr\u00e1vn\u00ed \u00fapravy a na zm\u00edrn\u011bn\u00ed n\u011bkter\u00fdch nastaven\u00fdch mantinel\u016f, nap\u0159. pokud jde o maxim\u00e1ln\u00ed d\u00e9lku zku\u0161ebn\u00ed doby \u010di minim\u00e1ln\u00ed d\u00e9lku v\u00fdpov\u011bdn\u00ed doby. V\u011bt\u0161inu takto lad\u011bn\u00fdch zm\u011bn ocen\u00ed zejm\u00e9na zam\u011bstnavatel\u00e9.<\/p>\n\n\n\n<p>Krom\u011b toho zavedla flexinovela rovn\u011b\u017e n\u011bkter\u00e9 dal\u0161\u00ed zm\u011bny, v\u010detn\u011b dlouhodob\u011b diskutovan\u00e9ho a velmi pozitivn\u00edho slou\u010den\u00ed v\u00fdpov\u011bdn\u00edch d\u016fvod\u016f pro pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti zam\u011bstnance k&nbsp;v\u00fdkonu pr\u00e1ce.&nbsp;&nbsp; &nbsp;<\/p>\n\n\n\n<p><strong>N\u00ed\u017ee vlo\u017een\u00e1 tabulka shrnuje bodov\u011b nejd\u016fle\u017eit\u011bj\u0161\u00ed zm\u011bny zaveden\u00e9 flexibiln\u00ed novelou, a to v\u010detn\u011b uveden\u00ed dot\u010den\u00fdch ustanoven\u00ed ZP.&nbsp;D\u00e1le v&nbsp;textu jsou jednotliv\u00e9 zm\u011bny pops\u00e1ny bl\u00ed\u017ee.<\/strong><strong><\/strong><\/p>\n\n\n\n<figure pr\u00e1ce na z\u00e1klad\u011b DPP a DP\u010c, garance n\u00e1vratu na stejn\u00e9 m\u00edsto<\/u><\/strong><\/h2>\n\n\n\n<p>Ustanoven\u00ed \u00a7 34b odst. 2 ZP po flexinovele umo\u017e\u0148uje, aby <strong>zam\u011bstnanec v pracovn\u00edm pom\u011bru, kter\u00fd \u010derp\u00e1 rodi\u010dovskou dovolenou, vykon\u00e1val u t\u00e9ho\u017e zam\u011bstnavatele pr\u00e1ci stejn\u00e9ho druhu na z\u00e1klad\u011b dohody o pracovn\u00ed \u010dinnosti nebo dohody o proveden\u00ed pr\u00e1ce<\/strong>. Jde tedy o v\u00fdjimku ze z\u00e1kladn\u00edho pracovn\u011bpr\u00e1vn\u00edho pravidla, podle n\u011bho\u017e zam\u011bstnanec v&nbsp;dal\u0161\u00edm z\u00e1kladn\u00edm pracovn\u011bpr\u00e1vn\u00edm vztahu u stejn\u00e9ho zam\u011bstnavatele nesm\u00ed vykon\u00e1vat pr\u00e1ce stejn\u00e9ho druhu.<\/p>\n\n\n\n<p>Komentovan\u00e1 zm\u011bna tedy umo\u017e\u0148uje, aby zam\u011bstnanec, nebo \u010dast\u011bji zam\u011bstnankyn\u011b \u010derpala v&nbsp;pracovn\u00edm pom\u011bru u zam\u011bstnavatele rodi\u010dovskou dovolenou a z\u00e1rove\u0148 pokra\u010dovala ve v\u00fdkonu stejn\u00e9 pr\u00e1ce bez nutnosti p\u0159eru\u0161en\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9. V\u00fdkon pr\u00e1ce v\u0161ak m\u016f\u017ee prob\u00edhat jedin\u011b na z\u00e1klad\u011b DPP \u010di DP\u010c a pouze v&nbsp;r\u00e1mci \u010dasov\u00fdch mantinel\u016f p\u0159edepsan\u00fdch pro tyto dohody.<\/p>\n\n\n\n<p>Sou\u010dasn\u011b byla v \u00a7 47 ZP <strong>pos\u00edlena garance \u201ezachov\u00e1n\u00ed stejn\u00e9 \u017eidle\u201c p\u0159i n\u00e1vratu zam\u011bstnance \u010di zam\u011bstnankyn\u011b z&nbsp;rodi\u010dovsk\u00e9 dovolen\u00e9<\/strong>. Zam\u011bstnavatel je nov\u011b povinen za\u0159adit zam\u011bstnance na p\u016fvodn\u00ed pr\u00e1ci a pracovi\u0161t\u011b tak\u00e9 tehdy, vrac\u00ed\u2011li se z rodi\u010dovsk\u00e9 dovolen\u00e9 <strong>je\u0161t\u011b p\u0159ed dnem, kdy d\u00edt\u011b dos\u00e1hne dvou let v\u011bku<\/strong>.<\/p>\n\n\n\n<p>Za dan\u00fdch okolnost\u00ed <strong>tedy neposta\u010d\u00ed, pokud bude navr\u00e1tiv\u0161\u00edmu zam\u011bstnanci p\u0159id\u011blov\u00e1na pr\u00e1ce podle pracovn\u00ed smlouvy<\/strong> (co\u017e m\u016f\u017ee b\u00fdt za ur\u010dit\u00fdch okolnost\u00ed spln\u011bno nap\u0159. i p\u0159i p\u0159e\u0159azen\u00ed na jin\u00e9 pracovi\u0161t\u011b), ale mus\u00ed b\u00fdt zachov\u00e1no pracovn\u00ed i m\u00edstn\u00ed za\u0159azen\u00ed z&nbsp;doby p\u0159ed n\u00e1stupem na rodi\u010dovskou dovolenou. Pokud p\u016fvodn\u00ed pr\u00e1ce odpadla nebo pracovi\u0161t\u011b bylo zru\u0161eno, je zam\u011bstnavatel povinen zam\u011bstnance za\u0159adit podle pracovn\u00ed smlouvy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 2) D\u00e9lka zku\u0161ebn\u00ed doby a jej\u00ed prodlu\u017eov\u00e1n\u00ed<\/u><\/strong><\/h2>\n\n\n\n<p><strong>Flexibiln\u00ed novela zavedla podstatn\u00e9 zm\u011bny tak\u00e9 do \u00fapravy zku\u0161ebn\u00ed doby v \u00a7 35 ZP. <\/strong>Tyto zm\u011bny se p\u0159itom dle p\u0159echodn\u00e9ho ustanoven\u00ed aplikuj\u00ed na zku\u0161ebn\u00ed dobu, kter\u00e1 byla sjedn\u00e1na nejd\u0159\u00edve 01.06.2025.<\/p>\n\n\n\n<p>Flexibiln\u00ed novela <strong>v&nbsp;prvn\u00ed \u0159ad\u011b prodlou\u017eila maxim\u00e1ln\u00ed d\u00e9lku zku\u0161ebn\u00ed doby, a to<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>obecn\u011b z&nbsp;3 m\u011bs\u00edc\u016f na 4 a<\/strong><\/li>\n\n\n\n<li><strong>u vedouc\u00edch zam\u011bstnanc\u016f z&nbsp;6 m\u011bs\u00edc\u016f na 8.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Byla tak\u00e9 zavedena <strong>mo\u017enost dodate\u010dn\u00e9ho prodlou\u017een\u00ed ji\u017e sjednan\u00e9 zku\u0161ebn\u00ed doby, a to <\/strong>na z\u00e1klad\u011b <strong>p\u00edsemn\u00e9 dohody stran uzav\u0159en\u00e9 v pr\u016fb\u011bhu zku\u0161ebn\u00ed doby a za dodr\u017een\u00ed jej\u00ed maxim\u00e1ln\u00ed d\u00e9lky, tj. 4 \u010di 8 m\u011bs\u00edc\u016f.<\/strong><\/p>\n\n\n\n<p><em>Plat\u00ed tedy nap\u0159\u00edklad, \u017ee zku\u0161ebn\u00ed doba, kter\u00e1 byla p\u016fvodn\u011b sjedn\u00e1na s \u201e\u0159adov\u00fdm zam\u011bstnancem\u201c na 2 m\u011bs\u00edce, m\u016f\u017ee b\u00fdt dodate\u010dn\u011b prodlou\u017eena a\u017e na 4 m\u011bs\u00edce.<\/em><\/p>\n\n\n\n<p>Dal\u0161\u00ed ze zm\u011bn se pak t\u00fdk\u00e1 <strong>pravidel prodlu\u017eov\u00e1n\u00ed zku\u0161ebn\u00ed doby ze z\u00e1kona<\/strong>, kdy se nov\u011b zku\u0161ebn\u00ed doba <strong>prodlu\u017euje tak\u00e9 o dny, v&nbsp;nich\u017e zam\u011bstnanec neomluven\u011b zame\u0161kal svou sm\u011bnu<\/strong>. Bylo p\u0159itom stanoveno, \u017ee se zku\u0161ebn\u00ed doba <strong>prodlu\u017euje o pracovn\u00ed dny<\/strong>, nikoliv o dny kalend\u00e1\u0159n\u00ed, co\u017e vyjad\u0159uje \u00a7 35 odst. 5 ZP n\u00e1sleduj\u00edc\u00edm textem.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p><em>\u201eZku\u0161ebn\u00ed doba se prodlu\u017euje o pracovn\u00ed dny zam\u011bstnance, v nich\u017e b\u011bhem zku\u0161ebn\u00ed doby neodpracoval celou sm\u011bnu z d\u016fvodu p\u0159ek\u00e1\u017eky v pr\u00e1ci, \u010derp\u00e1n\u00ed dovolen\u00e9 nebo neomluven\u00e9ho zame\u0161k\u00e1n\u00ed pr\u00e1ce.\u201c <\/em>Pokud zam\u011bstnanec z&nbsp;uveden\u00fdch d\u016fvod\u016f zame\u0161k\u00e1 <strong>pouze \u010d\u00e1st sv\u00e9 sm\u011bny, k&nbsp;prodlou\u017een\u00ed zku\u0161ebn\u00ed doby nedoch\u00e1z\u00ed<\/strong>.<\/p>\n\n\n\n<p>Rozhoduj\u00edc\u00edm pro ur\u010den\u00ed, o kolik dn\u016f bude ze z\u00e1kona zku\u0161ebn\u00ed doba prodlou\u017eena, je tud\u00ed\u017e<strong> po\u010det zame\u0161kan\u00fdch cel\u00fdch sm\u011bn z v\u00fd\u0161e vy\u010dten\u00fdch d\u016fvod\u016f. <\/strong>Zame\u0161kan\u00e9 sm\u011bny se n\u00e1sledn\u011b zam\u011bstnanci \u201enapo\u010d\u00edt\u00e1vaj\u00ed\u201c k datu, kdy m\u011bla zku\u0161ebn\u00ed doba p\u016fvodn\u011b skon\u010dit<strong>.<\/strong> Ve zkratce tedy doch\u00e1z\u00ed k&nbsp;p\u0159ipo\u010dten\u00ed po\u010dtu pracovn\u00edch dn\u016f, kter\u00e9 odpov\u00eddaj\u00ed zame\u0161kan\u00fdm sm\u011bn\u00e1m, ke sjednan\u00e9mu datu skon\u010den\u00ed zku\u0161ebn\u00ed doby.<\/p>\n\n\n\n<p>V&nbsp;n\u00e1vaznosti na d\u016fvodovou zpr\u00e1vu k&nbsp;flexinovele lze uv\u00e9st <strong>n\u00e1sleduj\u00edc\u00ed p\u0159\u00edklad prodlou\u017een\u00ed zku\u0161ebn\u00ed doby ze z\u00e1kona.<\/strong><\/p>\n\n\n\n<p><em>Zku\u0161ebn\u00ed doba byla u \u0159adov\u00e9ho zam\u011bstnance pracuj\u00edc\u00edho pravideln\u011b od pond\u011bl\u00ed do p\u00e1tku sjedn\u00e1na na 4 m\u011bs\u00edce, tj. od 01.07.2025 do 31.10.2025. Zam\u011bstnanec v r\u00e1mci zku\u0161ebn\u00ed doby 5 cel\u00fdch sm\u011bn neodpracoval z d\u016fvodu p\u0159ek\u00e1\u017eky v pr\u00e1ci (DPN), 2 cel\u00e9 sm\u011bny neodpracoval z d\u016fvodu \u010derp\u00e1n\u00ed dovolen\u00e9 a 3 cel\u00e9 sm\u011bny rovn\u011b\u017e fakticky nepracoval, nebo\u0165 mu na n\u011b p\u0159ipadl sv\u00e1tek (sm\u011bna mu z d\u016fvodu sv\u00e1tku tzv. odpadla a m\u011bl \u201eplacen\u00fd sv\u00e1tek\u201c). D\u00e1le 3kr\u00e1t zame\u0161kal cca polovinu sm\u011bny z d\u016fvodu vy\u0161et\u0159en\u00ed u l\u00e9ka\u0159e.<\/em><\/p>\n\n\n\n<p><em>Zam\u011bstnanci se zku\u0161ebn\u00ed doba prodlou\u017e\u00ed o celkem 7 pracovn\u00edch dn\u00ed (5 cel\u00fdch sm\u011bn zame\u0161kal kv\u016fli DPN, 2 sm\u011bny z d\u016fvodu \u010derp\u00e1n\u00ed dovolen\u00e9). O tzv. placen\u00e9 sv\u00e1tky a \u010d\u00e1ste\u010dn\u011b zame\u0161kan\u00e9 sm\u011bny se zku\u0161ebn\u00ed doba neprodlu\u017euje. Od 01.11.2025 je tedy t\u0159eba \u201enapo\u010d\u00edtat\u201c 7 pracovn\u00edch dn\u00ed, resp. 7 sm\u011bn. Zku\u0161ebn\u00ed doba tak skon\u010d\u00ed v \u00fater\u00fd 11.11.2025.<\/em><\/p>\n\n\n\n<p>Komentovan\u00e1 pravidla prodlu\u017eov\u00e1n\u00ed zku\u0161ebn\u00ed doby pravd\u011bpodobn\u011b nebudou \u010dinit obt\u00ed\u017ee p\u0159i \u201estandardn\u00edm nastaven\u00ed\u201c pracovn\u00edho pom\u011bru, tedy takov\u00e9m, kdy zam\u011bstnanec pracuje v&nbsp;pravideln\u00e9m rozvr\u017een\u00ed pracovn\u00ed doby s&nbsp;nem\u011bnn\u00fdm \u00favazkem. <strong>Podstatn\u011b komplikovan\u011bj\u0161\u00ed v\u0161ak m\u016f\u017ee b\u00fdt v\u00fdpo\u010det nap\u0159. p\u0159i nerovnom\u011brn\u011b rozvrhovan\u00e9 pracovn\u00ed dob\u011b, v&nbsp;r\u00e1mci samorozvrhov\u00e1n\u00ed pracovn\u00ed doby zam\u011bstnancem \u010di p\u0159i zm\u011bn\u011b rozsahu pracovn\u00ed doby zam\u011bstnance v&nbsp;pr\u016fb\u011bhu zku\u0161ebn\u00ed doby.&nbsp;&nbsp;&nbsp;<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 3) V\u00fdjimka pro maxim\u00e1ln\u00ed po\u010det opakov\u00e1n\u00ed pracovn\u00edch pom\u011br\u016f na dobu ur\u010ditou<\/u><\/strong><\/h2>\n\n\n\n<p>Pr\u00e1vn\u00ed \u00faprava obsa\u017een\u00e1 v&nbsp;\u00a7 39 odst. 2 ZP stanovuje, \u017ee <strong>pracovn\u00ed pom\u011br na dobu ur\u010ditou m\u016f\u017ee b\u00fdt sjedn\u00e1n mezi stejn\u00fdmi stranami maxim\u00e1ln\u011b 3kr\u00e1t po sob\u011b <\/strong>(tj. pravidlo \u201et\u0159ikr\u00e1t a dost\u201c). Flexibiln\u00ed novela zavedla dal\u0161\u00ed <strong>v\u00fdjimku z&nbsp;tohoto z\u00e1kladn\u00edho pravidla, a to pro situace, kdy zam\u011bstnanec nastupuje jako n\u00e1hrada<\/strong> za do\u010dasn\u011b nep\u0159\u00edtomn\u00e9ho zam\u011bstnance <strong>po dobu jeho mate\u0159sk\u00e9, otcovsk\u00e9 nebo rodi\u010dovsk\u00e9 dovolen\u00e9 a tak\u00e9 dovolen\u00e9 podle \u00a7 217 odst. 5 \u010derpan\u00e9 mezi mate\u0159skou a rodi\u010dovskou dovolenou<\/strong>.<\/p>\n\n\n\n<p>Novela v\u0161ak nijak <strong>nezasahuje do stanoven\u00fdch limit\u016f t\u00fdkaj\u00edc\u00edch se d\u00e9lky<\/strong>. Jeden pracovn\u00ed pom\u011br na dobu ur\u010ditou tak m\u016f\u017ee i u dan\u00e9ho zastupuj\u00edc\u00edho zam\u011bstnance trvat <strong>nejd\u00e9le 3 roky a celkov\u00e1 doba trv\u00e1n\u00ed opakovan\u00fdch pracovn\u00edch pom\u011br\u016f nesm\u00ed p\u0159es\u00e1hnout 9 let<\/strong>.<\/p>\n\n\n\n<p>Dle p\u0159echodn\u00e9ho ustanoven\u00ed je <strong>mo\u017en\u00e9 uvedenou v\u00fdjimku pou\u017e\u00edt i pro pracovn\u00ed pom\u011br na dobu ur\u010ditou uzav\u0159en\u00fd p\u0159ed 01.06.2025<\/strong>. Celkov\u00e1 doba trv\u00e1n\u00ed pracovn\u00edch pom\u011br\u016f na dobu ur\u010ditou v\u010detn\u011b doby jejich trv\u00e1n\u00ed p\u0159ed 01.06.2025 v\u0161ak nesm\u00ed p\u0159es\u00e1hnout 9 let ode dne vzniku prvn\u00edho pracovn\u00edho pom\u011bru na dobu ur\u010ditou.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 4) Zm\u011bna \u00fapravy d\u00e9lky a b\u011bhu v\u00fdpov\u011bdn\u00ed doby u v\u00fdpov\u011bdi z pracovn\u00edho pom\u011bru, del\u0161\u00ed prekluzivn\u00ed lh\u016fty<\/u><\/strong><\/h2>\n\n\n\n<p>Podstatn\u011b se zm\u011bnila tak\u00e9 <strong>\u00faprava d\u00e9lky a po\u010d\u00edt\u00e1n\u00ed v\u00fdpov\u011bdn\u00ed doby p\u0159i v\u00fdpov\u011bdi z&nbsp;pracovn\u00edho pom\u011bru dan\u00e9 zam\u011bstnavatelem dle \u00a7 51 ZP<\/strong>. Tato nov\u00e1 regulace <strong>se pou\u017eije na v\u00fdpov\u011bdi doru\u010den\u00e9 zam\u011bstnanc\u016fm 01.06.2025 a pozd\u011bji<\/strong>.<\/p>\n\n\n\n<p>V&nbsp;prvn\u00ed \u0159ad\u011b nov\u011b plat\u00ed, \u017ee je pro ur\u010den\u00ed <strong>minim\u00e1ln\u00ed (z\u00e1konn\u00e9) d\u00e9lky v\u00fdpov\u011bdn\u00ed doby<\/strong> <strong>rozhoduj\u00edc\u00ed, z&nbsp;jak\u00e9ho d\u016fvodu byla v\u00fdpov\u011b\u010f d\u00e1na.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pokud jde o d\u016fvody dle<strong> \u00a7 52 p\u00edsm. f) a\u017e h) ZP <\/strong>(nespl\u0148ov\u00e1n\u00ed p\u0159edpoklad\u016f \u010di po\u017eadavk\u016f a poru\u0161ov\u00e1n\u00ed povinnost\u00ed zam\u011bstnancem),\u010din\u00ed nov\u011b v\u00fdpov\u011bdn\u00ed doba ze z\u00e1kona<strong> nejm\u00e9n\u011b 1 m\u011bs\u00edc.<\/strong><\/li>\n\n\n\n<li>U ostatn\u00edch d\u016fvod\u016f z\u016fstala zachov\u00e1na p\u0159edchoz\u00ed<strong> minim\u00e1ln\u011b 2m\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed doba.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Flexibiln\u00ed novela p\u0159inesla z\u00e1sadn\u00ed zm\u011bnu tak\u00e9 do \u00fapravy&nbsp;b\u011bhu v\u00fdpov\u011bdn\u00ed doby. Konkr\u00e9tn\u011b \u00a7 51 odst. 1 ZP nov\u011b stanov\u00ed, \u017ee <em>v\u00fdpov\u011bdn\u00ed doba za\u010d\u00edn\u00e1 ji\u017e dnem, v n\u011bm\u017e byla v\u00fdpov\u011b\u010f doru\u010dena druh\u00e9 smluvn\u00ed stran\u011b, a kon\u010d\u00ed dnem, kter\u00fd se s t\u00edmto dnem \u010d\u00edseln\u011b shoduje. <\/em><\/strong><em>Nen\u00ed-li takov\u00fd den v posledn\u00edm m\u011bs\u00edci, p\u0159ipadne konec v\u00fdpov\u011bdn\u00ed doby na posledn\u00ed den m\u011bs\u00edce.<\/em> V\u00fdpov\u011bdn\u00ed doba tedy <strong>ji\u017e neb\u011b\u017e\u00ed a\u017e od prvn\u00edho dne kalend\u00e1\u0159n\u00edho m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po doru\u010den\u00ed v\u00fdpov\u011bdi<\/strong>.<\/p>\n\n\n\n<p><em>Pokud zam\u011bstnavatel doru\u010d\u00ed zam\u011bstnanci 16.06. v\u00fdpov\u011b\u010f <\/em><em>z&nbsp;pracovn\u00edho pom\u011bru pro nadbyte\u010dnost, bude dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed doba dle nov\u00fdch pravidel kon\u010dit 16.08.<\/em><\/p>\n\n\n\n<p>Flexibiln\u00ed novela sou\u010dasn\u011b v \u00a7 58 ZP <strong>prodlou\u017eila prekluzivn\u00ed lh\u016fty pro doru\u010den\u00ed v\u00fdpov\u011bdi \u010di okam\u017eit\u00e9ho zru\u0161en\u00ed pracovn\u00edho pom\u011bru v souvislosti s poru\u0161en\u00edm povinnost\u00ed zam\u011bstnancem<\/strong>. Nov\u011b je zam\u011bstnavatel opr\u00e1vn\u011bn rozv\u00e1zat pracovn\u00ed pom\u011br nikoliv do 2 m\u011bs\u00edc\u016f, ale <strong>do 3 m\u011bs\u00edc\u016f<\/strong> ode dne, kdy se o d\u016fvodu v\u00fdpov\u011bdi \u010di okam\u017eit\u00e9ho zru\u0161en\u00ed <strong>dozv\u011bd\u011bl<\/strong>, a <strong>maxim\u00e1ln\u011b do 15 m\u011bs\u00edc\u016f<\/strong> (d\u0159\u00edve 1 rok) ode dne, kdy d\u016fvod k v\u00fdpov\u011bdi nebo k okam\u017eit\u00e9mu zru\u0161en\u00ed pracovn\u00edho pom\u011bru vznikl. Prodlou\u017een\u00e9 lh\u016fty se pou\u017eij\u00ed pro d\u016fvody, kter\u00e9 vznikly od 01.06.2025.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 5 a 6) Slou\u010den\u00ed v\u00fdpov\u011bdn\u00edch d\u016fvod\u016f pro dlouhodob\u00e9 pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti a nahrazen\u00ed odstupn\u00e9ho jednor\u00e1zovou n\u00e1hradou \u00fajmy<\/u><\/strong><\/h2>\n\n\n\n<p>Dal\u0161\u00ed podstatnou zm\u011bnou je <strong>slou\u010den\u00ed v\u00fdpov\u011bdn\u00edch d\u016fvod\u016f spojen\u00fdch s dlouhodob\u00fdm pozbyt\u00edm zdravotn\u00ed zp\u016fsobilosti zam\u011bstnance k&nbsp;v\u00fdkonu pr\u00e1ce<\/strong>, obsa\u017een\u00fdch p\u0159ed novelou v \u00a7 52 p\u00edsm. d) a e) ZP. Nov\u011b jsou dan\u00e9 situace zahrnuty <strong>do jedin\u00e9ho obecn\u00e9ho d\u016fvodu v \u00a7 52 p\u00edsm. d) ZP<\/strong>, kter\u00fd spo\u010d\u00edv\u00e1 v tom, \u017ee zam\u011bstnanec pozbyl <em>\u201evzhledem ke sv\u00e9mu zdravotn\u00edmu stavu podle l\u00e9ka\u0159sk\u00e9ho posudku vydan\u00e9ho poskytovatelem pracovn\u011bl\u00e9ka\u0159sk\u00fdch slu\u017eeb nebo rozhodnut\u00ed p\u0159\u00edslu\u0161n\u00e9ho spr\u00e1vn\u00edho org\u00e1nu, kter\u00fd l\u00e9ka\u0159sk\u00fd posudek p\u0159ezkoum\u00e1v\u00e1, dlouhodob\u011b zp\u016fsobilost konat d\u00e1le dosavadn\u00ed pr\u00e1ci\u201c.<\/em><\/p>\n\n\n\n<p>Nov\u011b <strong>tud\u00ed\u017e nen\u00ed pro rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru podstatn\u00e9, z jak\u00e9 p\u0159\u00ed\u010diny je zam\u011bstnanec dlouhodob\u011b zdravotn\u011b nezp\u016fsobil\u00fd<\/strong> (pracovn\u00ed \u00faraz, nemoc z&nbsp;povol\u00e1n\u00ed \u010di obecn\u00e9 onemocn\u011bn\u00ed), co\u017e zam\u011bstnavatel\u016fm m\u016f\u017ee v&nbsp;n\u011bkter\u00fdch situac\u00edch podstatn\u011b \u201ezjednodu\u0161it \u017eivot\u201c. V\u00fdpov\u011b\u010f je toti\u017e <strong>mo\u017en\u00e9 zam\u011bstnanci doru\u010dit ji\u017e na z\u00e1klad\u011b l\u00e9ka\u0159sk\u00e9ho posudku o dlouhodob\u00e9m pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti<\/strong>, kter\u00fd <strong>zat\u00edm neur\u010duje p\u0159\u00ed\u010dinu t\u00e9to nezp\u016fsobilosti<\/strong>. <strong>Soud pak nem\u016f\u017ee rozhodnout o neplatnosti v\u00fdpov\u011bdi jen z&nbsp;d\u016fvodu zji\u0161t\u011bn\u00ed chybn\u00e9ho ur\u010den\u00ed p\u0159\u00ed\u010diny nezp\u016fsobilosti<\/strong>, jak se to pom\u011brn\u011b \u010dasto d\u011blo a d\u011bje v&nbsp;p\u0159\u00edpadech \u0159e\u0161en\u00fdch dle p\u0159edchoz\u00ed pr\u00e1vn\u00ed \u00fapravy.<\/p>\n\n\n\n<p>V \u00a7 52 p\u00edsm. e) ZP z\u016fst\u00e1v\u00e1 upravena pouze velmi specifick\u00e1 situace, kdy zam\u011bstnanec dos\u00e1hl na pracovi\u0161ti ur\u010den\u00e9m rozhodnut\u00edm p\u0159\u00edslu\u0161n\u00e9ho org\u00e1nu ochrany ve\u0159ejn\u00e9ho zdrav\u00ed nejvy\u0161\u0161\u00ed p\u0159\u00edpustn\u00e9 expozice. &nbsp;<\/p>\n\n\n\n<p>Podobn\u011b byly <strong>slou\u010deny tak\u00e9 d\u016fvody pro p\u0159eveden\u00ed zam\u011bstnance na jinou pr\u00e1ci dle dosavadn\u00edch p\u00edsm. a) a b) \u00a7 41 odst. 1 ZP<\/strong>.<\/p>\n\n\n\n<p>D\u016fle\u017eit\u00e1 souvisej\u00edc\u00ed zm\u011bna se odehr\u00e1la v \u00a7 67 ZP, v&nbsp;n\u011bm\u017e nov\u011b <strong>chyb\u00ed regulace pr\u00e1va zam\u011bstnance na odstupn\u00e9 ve v\u00fd\u0161i 12n\u00e1sobku pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku<\/strong>, pokud jeho pracovn\u00ed pom\u011br skon\u010dil v\u00fdpov\u011bdi nebo dohodou z&nbsp;d\u016fvodu dlouhodob\u00e9ho pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti pro pracovn\u00ed \u00faraz, nemoc z&nbsp;povol\u00e1n\u00ed \u010di ohro\u017een\u00ed touto nemoc\u00ed [d\u0159\u00edv\u011bj\u0161\u00ed \u00a7 52 p\u00edsm. d) ZP].<\/p>\n\n\n\n<p><strong>T\u011bmto zam\u011bstnanc\u016fm nov\u011b dle \u00a7 271ca ZP n\u00e1le\u017e\u00ed zcela nov\u00fd druh jednor\u00e1zov\u00e9 n\u00e1hrady nemajetkov\u00e9 \u00fajmy p\u0159i pracovn\u00edm \u00farazu \u010di nemoci z povol\u00e1n\u00ed, a to jednor\u00e1zov\u00e1 n\u00e1hradu p\u0159i skon\u010den\u00ed pracovn\u00edho pom\u011bru, poskytovan\u00e1 rovn\u011b\u017e ve v\u00fd\u0161i 12n\u00e1sobku pr\u016fm\u011brn\u00e9ho m\u011bs\u00ed\u010dn\u00edho v\u00fdd\u011blku zam\u011bstnance.<\/strong><\/p>\n\n\n\n<p><strong>Zam\u011bstnavatel\u00e9 zejm\u00e9na ocen\u00ed, \u017ee je dan\u00e1 n\u00e1hrada na rozd\u00edl od odstupn\u00e9ho hrazen\u00e1 ze z\u00e1konn\u00e9ho poji\u0161t\u011bn\u00ed odpov\u011bdnosti zam\u011bstnavatele. <\/strong>P\u0159i spln\u011bn\u00ed pojistn\u00fdch podm\u00ednek tud\u00ed\u017e zam\u011bstnavatel nov\u011b nemus\u00ed zam\u011bstnanc\u016fm hradit n\u00e1hradu (odstupn\u00e9) ve v\u00fd\u0161i ro\u010dn\u00edho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku z&nbsp;vlastn\u00edch finan\u010dn\u00edch prost\u0159edk\u016f.<\/p>\n\n\n\n<p>Odstupn\u00e9 z\u016fstalo zachov\u00e1no pouze pro p\u0159\u00edpad, kdy bude se zam\u011bstnancem rozv\u00e1z\u00e1n pracovn\u00ed pom\u011br v\u00fdpov\u011bd\u00ed nebo dohodou z d\u016fvodu dosa\u017een\u00ed nejvy\u0161\u0161\u00ed p\u0159\u00edpustn\u00e9 expozice [st\u00e1vaj\u00edc\u00ed \u00a7 52 p\u00edsm. e) ZP].<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 7) Dovolen\u00e1 p\u0159i neplatn\u00e9m rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru, moderace n\u00e1hrady mzdy<\/u><\/strong><\/h2>\n\n\n\n<p>V&nbsp;reakci na judikaturu Soudn\u00edho dvora EU zavedla flexibiln\u00ed novela v \u00a7 69 ZP v\u00fdslovn\u00e9 pravidlo, podle n\u011bho\u017e <strong>p\u0159i neplatn\u00e9m rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru n\u00e1le\u017e\u00ed zam\u011bstnanci za dobu trv\u00e1n\u00ed soudn\u00edho sporu nejen n\u00e1hrada mzdy, ale i pr\u00e1vo na dovolenou<\/strong>.<\/p>\n\n\n\n<p>Pokud tedy zam\u011bstnanec vyhr\u00e1l se zam\u011bstnavatelem soudn\u00ed spor o ur\u010den\u00ed neplatnosti rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru a z\u00e1rove\u0148 ozn\u00e1mil, \u017ee trv\u00e1 na dal\u0161\u00edm zam\u011bstn\u00e1v\u00e1n\u00ed, jeho pracovn\u00ed pom\u011br trv\u00e1 d\u00e1le a <strong>vznik\u00e1 mu pr\u00e1vo na dovolenou<\/strong>. Jde o potvrzen\u00ed v\u00fdkladu, kter\u00fd byl dovozov\u00e1n ji\u017e za p\u0159edchoz\u00ed pr\u00e1vn\u00ed \u00fapravy, \u017ee se <strong>doba trv\u00e1n\u00ed soudn\u00edho sporu pova\u017euje pro \u00fa\u010dely dovolen\u00e9 jako odpracovan\u00e1, i kdy\u017e zam\u011bstnanec pr\u00e1ci re\u00e1ln\u011b nekonal<\/strong> \u2013 vznik\u00e1 mu tud\u00ed\u017e pr\u00e1vo na dovolenou, kter\u00e1 mus\u00ed b\u00fdt poskytnuta, nebo (v p\u0159\u00edpad\u011b n\u00e1sledn\u00e9ho skon\u010den\u00ed pracovn\u00edho pom\u011bru) propl\u00e1cena.<\/p>\n\n\n\n<p>V&nbsp;r\u00e1mci flexibiln\u00ed novely do\u0161lo tak\u00e9 <strong>k roz\u0161\u00ed\u0159en\u00ed demonstrativn\u00edho v\u00fd\u010dtu d\u016fvod\u016f pro moderaci (sn\u00ed\u017een\u00ed) n\u00e1hrady mzdy<\/strong> poskytovan\u00e9 zam\u011bstnanci p\u0159i neplatn\u00e9m rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru o p\u0159\u00edpady, kdy zam\u011bstnanec v dob\u011b sporu vykon\u00e1val <strong>\u201ejinou v\u00fdd\u011ble\u010dnou \u010dinnost\u201c \u2013 nap\u0159. jako OSV\u010c.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 8) Lehk\u00e9 pr\u00e1ce 14let\u00fdch zam\u011bstnanc\u016f v&nbsp;obdob\u00ed letn\u00edch pr\u00e1zdnin<\/u><\/strong><\/h2>\n\n\n\n<p>V&nbsp;r\u00e1mci flexibiln\u00ed novely do\u0161lo tak\u00e9 ke zm\u011bn\u011b ob\u010dansk\u00e9ho z\u00e1kon\u00edku, <strong>p\u0159esn\u011bji k&nbsp;dopln\u011bn\u00ed jeho \u00a7 34, kter\u00fd upravuje v\u011bkovou hranici pro v\u00fdkon z\u00e1visl\u00e9 pr\u00e1ce<\/strong>. Nov\u011b je v\u00fdkon t\u00e9to pr\u00e1ce v&nbsp;pracovn\u011bpr\u00e1vn\u00edm vztahu umo\u017en\u011bn<strong> mladistv\u00fdm mezi 14. a 15. rokem v\u011bku, a d\u00e1le 15let\u00fdm a star\u0161\u00edm mladistv\u00fdm, kte\u0159\u00ed je\u0161t\u011b neukon\u010dili povinnou \u0161koln\u00ed doch\u00e1zku.<\/strong><\/p>\n\n\n\n<p>Je tedy mo\u017en\u00e9, aby dan\u00e9 osoby p\u016fsobily jako zam\u011bstnanci, ov\u0161em <strong>pouze v obdob\u00ed hlavn\u00edch (letn\u00edch) pr\u00e1zdnin, v\u00fdhradn\u011b s&nbsp;p\u00edsemn\u00fdm souhlasem z\u00e1konn\u00e9ho z\u00e1stupce a za dal\u0161\u00edch omezuj\u00edc\u00ed pravidel stanoven\u00fdch v&nbsp;ZP. <\/strong>Mezi st\u011b\u017eejn\u00ed podm\u00ednky pat\u0159\u00ed zejm\u00e9na<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>omezen\u00ed mo\u017en\u00e9ho zam\u011bstn\u00e1n\u00ed v\u00fdhradn\u011b pro v\u00fdkon lehk\u00fdch prac\u00ed, a to za podm\u00ednky, \u017ee tyto pr\u00e1ce nebudou \u0161kodit zdrav\u00ed, vzd\u011bl\u00e1v\u00e1n\u00ed a mor\u00e1ln\u00edmu rozvoji dan\u00fdch zam\u011bstnanc\u016f <\/strong>(\u00a7 244a ZP); lehk\u00fdmi pracemi se p\u0159itom rozum\u00ed pr\u00e1ce za\u0159azen\u00e9 do 1. kategorie rizikovosti podle z\u00e1kona o ochran\u011b ve\u0159ejn\u00e9ho zdrav\u00ed, pokud sou\u010d\u00e1st\u00ed pr\u00e1ce nen\u00ed \u010dinnost, pro jej\u00ed\u017e v\u00fdkon jsou podm\u00ednky stanoveny jin\u00fdm pr\u00e1vn\u00edm p\u0159edpisem;<\/li>\n\n\n\n<li><strong>stanoven\u00ed maxim\u00e1ln\u00ed d\u00e9lky sm\u011bny na 7 hodin a maxim\u00e1ln\u00ed t\u00fddenn\u00ed pracovn\u00ed doby na 35 hodin<\/strong> (\u00a7 79a odst. 1 ZP);<\/li>\n\n\n\n<li><strong>stanoven\u00ed minim\u00e1ln\u00ed doby nep\u0159etr\u017eit\u00e9ho denn\u00edho odpo\u010dinku na 14 hodin b\u011bhem 24 hodin po sob\u011b jdouc\u00edch <\/strong>(\u00a7 90 ZP);<\/li>\n\n\n\n<li><strong>stanoven\u00ed z\u00e1kazu zam\u011bstn\u00e1vat dan\u00e9 zam\u011bstnance prac\u00ed p\u0159es\u010das, prac\u00ed v&nbsp;noci a tak\u00e9 prac\u00ed mezi 20. a 22. hodinou<\/strong> (\u00a7 245 ZP).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 9) Prokazov\u00e1n\u00ed podm\u00ednek p\u016fsoben\u00ed odborovou organizac\u00ed<\/u><\/strong><\/h2>\n\n\n\n<p>D\u00e1le do\u0161lo v&nbsp;n\u00e1vaznosti na judikaturu Nejvy\u0161\u0161\u00edho soudu k zaveden\u00ed <strong>povinnosti odborov\u00e9 organizace, kterou o to zam\u011bstnavatel po\u017e\u00e1d\u00e1<\/strong>, <strong>prok\u00e1zat bez zbyte\u010dn\u00e9ho odkladu<\/strong> spln\u011bn\u00ed podm\u00ednky pro p\u016fsoben\u00ed u zam\u011bstnavatele v&nbsp;podob\u011b <strong>minim\u00e1ln\u00edho po\u010dtu 3 \u010dlen\u016f v pracovn\u00edm pom\u011bru u zam\u011bstnavatele<\/strong>.<\/p>\n\n\n\n<p>Jestli\u017ee tud\u00ed\u017e bude m\u00edt zam\u011bstnavatel pochybnosti, zda odbory spl\u0148uj\u00ed danou podm\u00ednku p\u016fsoben\u00ed, m\u016f\u017ee v&nbsp;souladu s \u00a7 286 odst. 4 ZP po\u017eadovat jej\u00ed prok\u00e1z\u00e1n\u00ed. <strong>Odborov\u00e1 organizace tud\u00ed\u017e nemus\u00ed k&nbsp;prokazov\u00e1n\u00ed p\u0159istupovat automaticky, jak p\u0159edt\u00edm dovodila judikatura, ale pouze v&nbsp;p\u0159\u00edpad\u011b, \u017ee ji k&nbsp;tomu zam\u011bstnavatel vyzve.<\/strong><\/p>\n\n\n\n<p><strong>Po\u017eaduje-li zam\u011bstnavatel prok\u00e1z\u00e1n\u00ed spln\u011bn\u00ed podm\u00ednek, m\u016f\u017ee odborov\u00e1 organizace zvolit jak\u00fdkoli zp\u016fsob, kter\u00fd je schopen osv\u011bd\u010dit jejich spln\u011bn\u00ed. <\/strong>Pokud nebude zvolen jin\u00fd zp\u016fsob, je odborov\u00e1 organizace povinna poskytnout nezbytnou sou\u010dinnost not\u00e1\u0159i, jeho\u017e sjedn\u00e1 a hrad\u00ed zam\u011bstnavatel za \u00fa\u010delem osv\u011bd\u010den\u00ed spln\u011bn\u00ed podm\u00ednky pot\u0159ebn\u00e9ho po\u010dtu \u010dlen\u016f.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u><strong><u>Ad 10) Zaveden\u00ed m\u00edrn\u011bj\u0161\u00ed \u00fapravy elektronick\u00e9ho doru\u010dov\u00e1n\u00ed mzdov\u00e9ho a platov\u00e9ho v\u00fdm\u011bru<\/u><\/strong><\/u><\/strong><\/h2>\n\n\n\n<p>Dal\u0161\u00ed zm\u011bna se t\u00fdk\u00e1 <strong>elektronick\u00e9ho doru\u010dov\u00e1n\u00ed mzdov\u00fdch (platov\u00fdch) v\u00fdm\u011br\u016f<\/strong> (v\u010d. jejich zm\u011bn), kter\u00e9 jsou nov\u011b dle \u00a7 113 odst. 4 ZP <strong>povinn\u011b p\u0159ed\u00e1v\u00e1ny zam\u011bstnanci p\u0159ed za\u010d\u00e1tkem v\u00fdkonu pr\u00e1ce <\/strong>(p\u0159edt\u00edm \u201ev den n\u00e1stupu do pr\u00e1ce\u201c).<\/p>\n\n\n\n<p>Zm\u00edn\u011bn\u00e9 dokumenty dle \u00a7 334 ZP <strong>st\u00e1le pat\u0159\u00ed mezi p\u00edsemnosti doru\u010dovan\u00e9 zam\u011bstnanci ve speci\u00e1ln\u00edm re\u017eimu do vlastn\u00edch rukou<\/strong>, ov\u0161em plat\u00ed pro n\u011b <strong>speci\u00e1ln\u00ed \u00faprava elektronick\u00e9ho doru\u010dov\u00e1n\u00ed<\/strong> (prost\u0159ednictv\u00edm s\u00edt\u011b nebo slu\u017eby elektronick\u00fdch komunikac\u00ed \u2013 nap\u0159. mailem). Konkr\u00e9tn\u011b byla zavedena mo\u017enost doru\u010dovat mzdov\u00e9 v\u00fdm\u011bry tak\u00e9 <strong>na jinou ne\u017e p\u00edsemn\u011b sd\u011blenou soukromou elektronickou adresu zam\u011bstnance<\/strong>, p\u0159i\u010dem\u017e se <strong>nepou\u017eij\u00ed<\/strong> ani dal\u0161\u00ed speci\u00e1ln\u00ed podm\u00ednky \u2013 <strong>nutn\u00e9 p\u0159edchoz\u00ed pou\u010den\u00ed zam\u011bstnavatelem a p\u00edsemn\u00fd souhlas zam\u011bstnance s elektronick\u00fdm doru\u010dov\u00e1n\u00edm<\/strong>.<\/p>\n\n\n\n<p>Narozd\u00edl od elektronick\u00e9ho doru\u010dov\u00e1n\u00ed jin\u00fdch p\u00edsemnost\u00ed <strong>se zde ov\u0161em z\u00e1rove\u0148 neuplatn\u00ed fikce doru\u010den\u00ed<\/strong> \u2013 doru\u010deno je okam\u017eikem, kdy p\u0159evzet\u00ed mzdov\u00e9ho v\u00fdm\u011bru zam\u011bstnanec zam\u011bstnavateli <strong>p\u00edsemn\u011b potvrd\u00ed<\/strong>. Pokud k&nbsp;tomu nedojde <strong>ve lh\u016ft\u011b 15 dn\u016f ode dne odesl\u00e1n\u00ed v\u00fdm\u011bru, je doru\u010den\u00ed ne\u00fa\u010dinn\u00e9<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><u>Ad 11) Zaveden\u00ed prioritn\u00edho zp\u016fsobu v\u00fdplaty mzdy na bankovn\u00ed \u00fa\u010det zam\u011bstnance, v\u00fdplata mzdy nebo platu v ciz\u00ed m\u011bn\u011b<\/u><\/strong><\/h2>\n\n\n\n<p><strong>S \u00fa\u010dinnost\u00ed flexibiln\u00ed novely se prioritn\u00edm zp\u016fsobem v\u00fdplaty mzdy \u010di platu stal bezhotovostn\u00ed p\u0159evod <\/strong>na platebn\u00ed \u00fa\u010det ur\u010den\u00fd zam\u011bstnancem. V\u00fdplata v hotovosti se prov\u00e1d\u00ed pouze v p\u0159\u00edpadech, kdy zam\u011bstnanec s bezhotovostn\u00edm zp\u016fsobem v\u00fdplaty projev\u00ed p\u00edsemn\u00fd nesouhlas, kdy nem\u00e1 z\u0159\u00edzen\u00fd bankovn\u00ed \u00fa\u010det, \u010di kdy k proveden\u00ed bezhotovostn\u00ed v\u00fdplaty neposkytne sou\u010dinnost. <strong>Zam\u011bstnavatel se v\u0161ak st\u00e1le m\u016f\u017ee se zam\u011bstnancem dohodnout na jin\u00e9m zp\u016fsobu v\u00fdplaty mzdy \u010di platu.<\/strong><\/p>\n\n\n\n<p>Krom\u011b toho flexibiln\u00ed novela<strong> roz\u0161\u00ed\u0159ila v \u00a7 143 ZP p\u0159\u00edpady, kdy je mo\u017en\u00e9 zam\u011bstnanci vypl\u00e1cet mzdu \u010di plat v ciz\u00ed m\u011bn\u011b <\/strong>(ke kter\u00e9 \u010cNB vyhla\u0161uje kurz). Mimo zam\u011bstnance s m\u00edstem v\u00fdkonu pr\u00e1ce v zahrani\u010d\u00ed je to umo\u017en\u011bno nap\u0159. u cizinc\u016f (z EU \u010di z tzv. \u201et\u0159et\u00edch zem\u00ed\u201c) pracuj\u00edc\u00edch v \u010cR.&nbsp;<\/p>\n\n\n\n<p><strong><u>Dal\u0161\u00ed zm\u011bny<\/u><\/strong><\/p>\n\n\n\n<p>Krom\u011b uveden\u00e9ho je vhodn\u00e9 upozornit je\u0161t\u011b na n\u00e1sleduj\u00edc\u00ed zm\u011bny.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nov\u00fd \u00a7 346a ZP <strong>zakazuje zam\u011bstnavateli omezovat zam\u011bstnance v nakl\u00e1d\u00e1n\u00ed s informacemi o v\u00fd\u0161i a struktu\u0159e jeho mzdy, platu nebo odm\u011bny z dohody<\/strong>. Bylo tedy v\u00fdslovn\u011b stanoveno, \u017ee zam\u011bstnavatel nesm\u00ed smluvn\u011b ani jinak zakazovat zam\u011bstnanci sd\u011blovat \u00fadaje o sv\u00e9 mzd\u011b (nap\u0159. spolupracovn\u00edk\u016fm). Tento z\u00e1kaz v\u0161ak lze patrn\u011b prolomit v&nbsp;p\u0159\u00edpadech d\u016fvodn\u00e9 ochrany obchodn\u00edho tajemstv\u00ed atd.<\/li>\n\n\n\n<li>V&nbsp;d\u016fsledku panuj\u00edc\u00edch nejasnost\u00ed se p\u0159edkladatel\u00e9 novely rozhodli tak\u00e9 <strong>zp\u0159esnit \u00fapravu po\u010d\u00edt\u00e1n\u00ed pr\u016fm\u011brn\u00e9ho m\u011bs\u00ed\u010dn\u00edho v\u00fdd\u011blku<\/strong> ve speci\u00e1ln\u00edch p\u0159\u00edpadech, kdy <strong>v&nbsp;pr\u016fb\u011bhu rozhodn\u00e9ho obdob\u00ed dojde ke zm\u011bn\u011b t\u00fddenn\u00ed pracovn\u00ed doby zam\u011bstnance<\/strong>. V&nbsp;takov\u00e9m p\u0159\u00edpad\u011b se podle \u00a7 356 odst. 2 ZP t\u00fddenn\u00ed pracovn\u00ed doba vypo\u010dte tak, \u017ee se sou\u010det uplatn\u011bn\u00fdch t\u00fddenn\u00edch pracovn\u00edch dob v hodin\u00e1ch vyn\u00e1soben\u00fd po\u010dtem hodin v nich odpracovan\u00fdch vyd\u011bl\u00ed celkov\u00fdm po\u010dtem odpracovan\u00fdch hodin v rozhodn\u00e9m obdob\u00ed.<\/li>\n\n\n\n<li>Pro zp\u0159esn\u011bn\u00ed bylo tak\u00e9 do \u00a7 360 ZP zakotveno pravidlo \u0159e\u0161\u00edc\u00ed p\u0159\u00edpady, kdy <strong>m\u00e1 b\u00fdt pr\u016fm\u011brn\u00fd v\u00fdd\u011blek pou\u017eit po skon\u010den\u00ed pracovn\u011bpr\u00e1vn\u00edho vztahu<\/strong> (nap\u0159. u odstupn\u00e9ho nebo u n\u00e1hrady mzdy za nevy\u010derpanou dovolenou). V&nbsp;t\u011bchto situac\u00edch se m\u00e1 dle n\u00e1vrhu pou\u017e\u00edt pr\u016fm\u011brn\u00fd v\u00fdd\u011blek <strong>zji\u0161t\u011bn\u00fd naposledy v pr\u016fb\u011bhu trv\u00e1n\u00ed pracovn\u011bpr\u00e1vn\u00edho vztahu<\/strong>.<\/li>\n\n\n\n<li>V \u00a7 247 ZP bylo up\u0159esn\u011bno, \u017ee je <strong>u v\u0161ech mladistv\u00fdch zam\u011bstnanc\u016f vy\u017eadov\u00e1no proveden\u00ed vstupn\u00ed prohl\u00eddky tak\u00e9 p\u0159ed vznikem vztahu z DPP \u010di DP\u010c<\/strong>.<\/li>\n\n\n\n<li>Pro p\u0159\u00edpad, kdy je to nezbytn\u00e9 k odvr\u00e1cen\u00ed hav\u00e1rie, \u017eiveln\u00ed ud\u00e1losti nebo jin\u00e9 <strong>mimo\u0159\u00e1dn\u00e9 ud\u00e1losti<\/strong>, pop\u0159\u00edpad\u011b k odstran\u011bn\u00ed \u010di zm\u00edrn\u011bn\u00ed jejich bezprost\u0159edn\u00edch n\u00e1sledk\u016f, bylo v \u00a7 90 ZP umo\u017en\u011bno <strong>zkr\u00e1cen\u00ed denn\u00edho odpo\u010dinku zam\u011bstnance star\u0161\u00edho 18 let a\u017e na 6 hodin b\u011bhem 24 hodin<\/strong> za podm\u00ednky adekv\u00e1tn\u00edho prodlou\u017een\u00ed doby n\u00e1sleduj\u00edc\u00edho odpo\u010dinku.<\/li>\n\n\n\n<li><strong>Zam\u011bstnankyn\u011b a zam\u011bstnanci pracuj\u00edc\u00ed v zahrani\u010d\u00ed<\/strong> nov\u011b maj\u00ed dle \u00a7 181 odst. 2 ZP pr\u00e1vo na n\u00e1hradu n\u011bkter\u00fdch v\u00fddaj\u016f v p\u0159\u00edpad\u011b, <strong>kdy \u010derpaj\u00ed v zahrani\u010d\u00ed mate\u0159skou nebo rodi\u010dovskou dovolenou.<\/strong><\/li>\n\n\n\n<li>D\u00e1le do\u0161lo k <strong>d\u00edl\u010d\u00edmu rozvoln\u011bn\u00ed podm\u00ednek stanoven\u00fdch v \u00a7 303 ZP pro soub\u011bh v\u00fdkonu pr\u00e1ce zam\u011bstnanc\u016f ve spr\u00e1vn\u00edch \u00fa\u0159adech<\/strong>, \u00fazemn\u00edch samospr\u00e1vn\u00fdch celc\u00edch atd. a \u010dlenstv\u00ed t\u011bchto osob v \u0159\u00edd\u00edc\u00edch nebo kontroln\u00edch org\u00e1nech podnikaj\u00edc\u00edch pr\u00e1vnick\u00fdch osob.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>N\u00e1sleduj\u00edc\u00ed text shrnuje podstatn\u00e9 zm\u011bny z\u00e1kon\u00edku pr\u00e1ce (d\u00e1le tak\u00e9 jako \u201eZP\u201c) zaveden\u00e9 s&nbsp;\u00fa\u010dinnost\u00ed k&nbsp;01.06. 2025 tzv. flexinovelou ZP, tedy z\u00e1konem \u010d. 120\/2025 Sb., kter\u00fdm se m\u011bn\u00ed ZP a n\u011bkter\u00e9 dal\u0161\u00ed p\u0159edpisy (d\u00e1le tak\u00e9 jako \u201eflexinovela\u201c \u010di \u201eflexibiln\u00ed novela\u201c).
