P\u0159edlo\u017een\u00fd \u010dl\u00e1nek se v hlub\u0161\u00edch souvislostech v\u011bnuje zm\u011bn\u00e1m u v\u00fdpov\u011bdn\u00ed doby, kdy auto\u0159i tyto zm\u011bny popisuj\u00ed a p\u0159edstavuj\u00ed n\u011bkter\u00e9 jejich mo\u017en\u00e9 dopady do praxe zam\u011bstnavatel\u016f. \u010cl\u00e1nek tak\u00e9 nasti\u0148uje mo\u017en\u00e9 sc\u00e9n\u00e1\u0159e, kter\u00fdm mohou zam\u011bstnavatel\u00e9 v souvislosti se zm\u011bnou uveden\u00e9 \u00fapravy \u010delit a uv\u00e1d\u00ed mo\u017enosti jejich \u0159e\u0161en\u00ed v kontextu p\u0159ijat\u00fdch zm\u011bn.<\/p>\n\n\n\n<p><strong>Zm\u011bny t\u00fdkaj\u00edc\u00ed se b\u011bhu v\u00fdpov\u011bdn\u00ed doby<\/strong><\/p>\n\n\n\n<p>P\u0159ed \u00fa\u010dinnost\u00ed novely (tj. ve zn\u011bn\u00ed z\u00e1kon\u00edku pr\u00e1ce \u00fa\u010dinn\u00e9m do 31.05.2025) platilo obecn\u00e9 pravidlo, kdy v\u00fdpov\u011bdn\u00ed doba po\u010dala b\u011b\u017eet od prvn\u00edho dne kalend\u00e1\u0159n\u00edho m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po doru\u010den\u00ed v\u00fdpov\u011bdi druh\u00e9 stran\u011b a skon\u010dila uplynut\u00edm posledn\u00edho dne p\u0159\u00edslu\u0161n\u00e9ho m\u011bs\u00edce (tj. posledn\u00edho m\u011bs\u00edce v\u00fdpov\u011bdn\u00ed doby). Kl\u00ed\u010dovou zm\u011bnou, kterou tzv. flexi novela z\u00e1kon\u00edku pr\u00e1ce p\u0159in\u00e1\u0161\u00ed, je pak \u00faprava po\u010d\u00e1tku b\u011bhu v\u00fdpov\u011bdn\u00ed doby, p\u0159i\u010dem\u017e nov\u011b tato b\u011b\u017e\u00ed ji\u017e ode dne, kdy je v\u00fdpov\u011b\u010f doru\u010dena druh\u00e9 stran\u011b a kon\u010d\u00ed toho dne posledn\u00edho m\u011bs\u00edce v\u00fdpov\u011bdn\u00ed doby, kter\u00fd se sv\u00fdm \u010d\u00edseln\u00fdm ozna\u010den\u00edm shoduje se dnem doru\u010den\u00ed v\u00fdpov\u011bdi. Jestli\u017ee nap\u0159\u00edklad byla zam\u011bstnavatelem doru\u010dena v\u00fdpov\u011b\u010f zam\u011bstnanci do vlastn\u00edch rukou na pracovi\u0161ti dne 15.06.2025, pracovn\u00ed pom\u011br zpravidla skon\u010d\u00ed dne 15.08.2025, s v\u00fdjimkou nap\u0159. v\u00fdpov\u011bdi uveden\u00e9 v \u00a7 51 odst. 2 p\u00edsm. a) a b) z\u00e1kon\u00edku pr\u00e1ce \u010di v p\u0159\u00edpad\u011b uplynut\u00ed v\u00fdpov\u011bdn\u00ed doby v ochrann\u00e9 dob\u011b dle \u00a7 53 odst. 2 z\u00e1kon\u00edku pr\u00e1ce.<\/p>\n\n\n\n<p>V\u00fdpov\u011bdn\u00ed dobu lze rovn\u011b\u017e prodlou\u017eit \u010di upravit jej\u00ed b\u011bh na z\u00e1klad\u011b p\u00edsemn\u00e9 dohody zam\u011bstnance a zam\u011bstnavatele. V r\u00e1mci takov\u00e9 dohody je mo\u017en\u00e9 ujednat tak\u00e9 po\u010d\u00e1tek b\u011bhu t\u00e9to doby dle pravidel z\u00e1kon\u00edku pr\u00e1ce \u00fa\u010dinn\u00fdch do 31.05.2025 \u2013 tzn. na z\u00e1klad\u011b dohody m\u016f\u017ee b\u00fdt po\u010d\u00e1tek b\u011bhu v\u00fdpov\u011bdn\u00ed doby v\u00e1z\u00e1n nikoli na okam\u017eik doru\u010den\u00ed v\u00fdpov\u011bdi druh\u00e9 stran\u011b, ale na prvn\u00ed den kalend\u00e1\u0159n\u00edho m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po kalend\u00e1\u0159n\u00edm m\u011bs\u00edci, v n\u011bm\u017e byla v\u00fdpov\u011b\u010f druh\u00e9 stran\u011b doru\u010dena.<\/p>\n\n\n\n<p><strong>Zkr\u00e1cen\u00ed d\u00e9lky v\u00fdpov\u011bdn\u00ed doby<\/strong><\/p>\n\n\n\n<p>Novela p\u0159in\u00e1\u0161\u00ed rovn\u011b\u017e d\u016fle\u017eitou zm\u011bnu v podob\u011b zkr\u00e1cen\u00ed d\u00e9lky v\u00fdpov\u011bdn\u00ed doby na jeden m\u011bs\u00edc u v\u00fdpov\u011bdi dan\u00e9 zam\u011bstnavatelem z d\u016fvod\u016f dle \u00a7 52 p\u00edsm. f) \u2013 h) z\u00e1kon\u00edku pr\u00e1ce, tj. pro nespl\u0148ov\u00e1n\u00ed p\u0159edpoklad\u016f \u010di po\u017eadavk\u016f pro v\u00fdkon pr\u00e1ce zam\u011bstnancem, pro poru\u0161ov\u00e1n\u00ed povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch z pr\u00e1vn\u00edch p\u0159edpis\u016f vztahuj\u00edc\u00edch se k zam\u011bstnancem vykon\u00e1van\u00e9 pr\u00e1ci \u010di pro zvl\u00e1\u0161\u0165 hrub\u00e9 poru\u0161en\u00ed povinnosti dle \u00a7 301a z\u00e1kon\u00edku pr\u00e1ce u zam\u011bstnance v do\u010dasn\u00e9 pracovn\u00ed neschopnosti.<\/p>\n\n\n\n<p>Zkr\u00e1cen\u00ed z\u00e1konn\u00e9 v\u00fdpov\u011bdn\u00ed doby u vybran\u00fdch v\u00fdpov\u011bdn\u00edch d\u016fvod\u016f je pak v\u00edtanou zm\u011bnou pro zam\u011bstnavatele v kombinaci pr\u00e1v\u011b s novou \u00fapravou b\u011bhu v\u00fdpov\u011bdn\u00ed doby, kdy jej\u00ed prim\u00e1rn\u00ed vyu\u017eit\u00ed v praxi shled\u00e1vaj\u00ed auto\u0159i p\u0159i v\u00fdpov\u011bdi zam\u011bstnavatele z d\u016fvodu poru\u0161ov\u00e1n\u00ed povinnost\u00ed vztahuj\u00edc\u00edch se k zam\u011bstnancem vykon\u00e1van\u00e9 pr\u00e1ci (\u00a7 52 p\u00edsm. g) z\u00e1kon\u00edku pr\u00e1ce). Oproti p\u0159edchoz\u00ed pr\u00e1vn\u00ed \u00faprav\u011b tak v\u00fdpov\u011bdn\u00ed doba zam\u011bstnance poru\u0161uj\u00edc\u00edho povinnosti bude trvat zpravidla pr\u00e1v\u011b (a pouze) jeden m\u011bs\u00edc. Pro srovn\u00e1n\u00ed, p\u0159ed \u00fa\u010dinnost\u00ed novely pak v\u00fdpov\u011bdn\u00ed doba mohla v d\u016fsledku \u0161patn\u00e9ho na\u010dasov\u00e1n\u00ed doru\u010den\u00ed v\u00fdpov\u011bdi zam\u011bstnanci trvat i t\u00e9m\u011b\u0159 t\u0159i cel\u00e9 m\u011bs\u00edce.<\/p>\n\n\n\n<p>V d\u016fsledku nov\u00e9 pr\u00e1vn\u00ed \u00fapravy proto stoj\u00ed za zv\u00e1\u017een\u00ed, zda zam\u011bstnavatel p\u0159i z\u00e1va\u017en\u011bj\u0161\u00edm poru\u0161en\u00ed povinnosti zam\u011bstnance (kter\u00e9 dle zam\u011bstnavatele napl\u0148uje intenzitu zvl\u00e1\u0161\u0165 hrub\u00e9ho poru\u0161en\u00ed) nam\u00edsto okam\u017eit\u00e9ho zru\u0161en\u00ed pracovn\u00edho pom\u011bru neu\u017eije z d\u016fvodu pr\u00e1vn\u00ed opatrnosti pr\u00e1v\u011b v\u00fdpov\u011bdi, kter\u00e1 je z pohledu p\u0159\u00edpadn\u00e9ho pr\u00e1vn\u00edho sporu jist\u011bj\u0161\u00ed variantou, kdy okam\u017eit\u00e9 zru\u0161en\u00ed pracovn\u00edho pom\u011bru ze strany zam\u011bstnavatele zpravidla vy\u017eaduje spln\u011bn\u00ed velmi p\u0159\u00edsn\u00e9ho standardu poru\u0161en\u00ed povinnost\u00ed ze strany zam\u011bstnance oproti v\u00fdpov\u011bdi.<\/p>\n\n\n\n<p><strong>Praktick\u00e9 dopady zm\u011bn na organiza\u010dn\u00ed zm\u011bny<\/strong><\/p>\n\n\n\n<p>Popsan\u00e9 zm\u011bny, t\u00fdkaj\u00edc\u00ed se v\u00fdpov\u011bdn\u00ed doby, maj\u00ed podstatn\u00fd dopad pro p\u0159ij\u00edm\u00e1n\u00ed rozhodnut\u00ed zam\u011bstnavatele o p\u0159ijet\u00ed organiza\u010dn\u00edch zm\u011bn, v jejich\u017e d\u016fsledku nap\u0159\u00edklad doch\u00e1z\u00ed ke zru\u0161en\u00ed zam\u011bstnavatele nebo jeho \u010d\u00e1sti \u010di v jejich\u017e d\u016fsledku se m\u00e1 zam\u011bstnanec st\u00e1t nadbyte\u010dn\u00fdm. Zam\u011bstnavatel\u00e9 mus\u00ed m\u00edt dle nov\u00e9 pr\u00e1vn\u00ed \u00fapravy pro spr\u00e1vn\u00e9 na\u010dasov\u00e1n\u00ed organiza\u010dn\u00ed zm\u011bny p\u0159edev\u0161\u00edm jistotu ohledn\u011b data, kdy bude v\u00fdpov\u011b\u010f doru\u010dena.<\/p>\n\n\n\n<p>Datum organiza\u010dn\u00ed zm\u011bny by dle z\u00e1v\u011br\u016f koment\u00e1\u0159ov\u00e9 literatury,<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> jako\u017e i ust\u00e1len\u00e9 rozhodovac\u00ed praxe Nejvy\u0161\u0161\u00edho soudu<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> m\u011blo bezprost\u0159edn\u011b n\u00e1sledovat po datu skon\u010den\u00ed pracovn\u00edho pom\u011bru (tj. po uplynut\u00ed v\u00fdpov\u011bdn\u00ed doby zam\u011bstnance). V&nbsp;p\u0159\u00edpad\u011b doru\u010den\u00ed v\u00fdpov\u011bdi k&nbsp;pozd\u011bj\u0161\u00edmu datu pak Nejvy\u0161\u0161\u00ed soud zpravidla dovozuje, \u017ee takto doru\u010den\u00e1 v\u00fdpov\u011b\u010f je neplatn\u00e1, nebo\u0165 nen\u00ed d\u00e1na p\u0159\u00ed\u010dinn\u00e1 souvislost v\u00fdpov\u011bdn\u00edho d\u016fvodu s&nbsp;organiza\u010dn\u00ed zm\u011bnou. Naopak, jestli\u017ee je datum \u00fa\u010dinnosti organiza\u010dn\u00ed zm\u011bny ur\u010deno tak, \u017ee nastane ji\u017e v pr\u016fb\u011bhu v\u00fdpov\u011bdn\u00ed doby, nezakl\u00e1d\u00e1 tato skute\u010dnost d\u016fvod pro neplatnost v\u00fdpov\u011bdi, av\u0161ak od tohoto dne nast\u00e1v\u00e1 p\u0159ek\u00e1\u017eka v pr\u00e1ci na stran\u011b zam\u011bstnavatele ve smyslu \u00a7 208 z\u00e1kon\u00edku pr\u00e1ce (nebo\u0165 v d\u016fsledku p\u0159ijat\u00e9 organiza\u010dn\u00ed zm\u011bny nem\u016f\u017ee zam\u011bstnavatel nad\u00e1le p\u0159id\u011blovat pr\u00e1ci zam\u011bstnanci dle pracovn\u00ed smlouvy), kdy vznik\u00e1 zam\u011bstnanci pr\u00e1vo na n\u00e1hradu mzdy ve v\u00fd\u0161i jeho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a><\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b, \u017ee zam\u011bstnavatel nem\u00e1 postaveno najisto, kdy bude v\u00fdpov\u011b\u010f zam\u011bstnanci doru\u010dena (nap\u0159. doru\u010duje-li zam\u011bstnavatel prost\u0159ednictv\u00edm provozovatele po\u0161tovn\u00edch slu\u017eeb), je vhodn\u011bj\u0161\u00ed postupovat tak, aby byla v\u00fdpov\u011b\u010f zam\u011bstnanci doru\u010dena sp\u00ed\u0161e k pozd\u011bj\u0161\u00edmu datu. Jestli\u017ee tak pl\u00e1nuje zam\u011bstnavatel nastavit datum \u00fa\u010dinnosti organiza\u010dn\u00ed zm\u011bny nap\u0159\u00edklad ke dni 01.09.2025, m\u011bl by v souladu s v\u00fd\u0161e uveden\u00fdmi z\u00e1v\u011bry zajistit, aby byla v\u00fdpov\u011b\u010f doru\u010dena zam\u011bstnanci nejd\u0159\u00edve dne 01.07.2025, aby nemohla b\u00fdt soudem p\u0159\u00edpadn\u011b prohl\u00e1\u0161ena za neplatnou (viz p\u0159\u00edklad a vysv\u011btlen\u00ed v\u00fd\u0161e). Pokud dojde k pozd\u011bj\u0161\u00edmu doru\u010den\u00ed v\u00fdpov\u011bdi, nem\u00e1 tato skute\u010dnost vliv na platnost v\u00fdpov\u011bdi. Zam\u011bstnavatel v\u0161ak bude povinen zam\u011bstnanci vyplatit n\u00e1hradu mzdy ve v\u00fd\u0161i pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za tuto dobu, jeliko\u017e zam\u011bstnavatel nebude moci ode dne nabyt\u00ed \u00fa\u010dinnosti organiza\u010dn\u00ed zm\u011bny do uplynut\u00ed v\u00fdpov\u011bdn\u00ed doby zam\u011bstnanci p\u0159id\u011blovat pr\u00e1ci podle pracovn\u00ed smlouvy, kdy se bude jednat o p\u0159ek\u00e1\u017eku v pr\u00e1ci na stran\u011b zam\u011bstnavatele ve smyslu \u00a7 208 z\u00e1kon\u00edku pr\u00e1ce (nap\u0159. p\u0159i doru\u010den\u00ed dne 04.07.2025 s datem \u00fa\u010dinnosti organiza\u010dn\u00ed zm\u011bny k 01.09.2025 skon\u010d\u00ed pracovn\u00ed pom\u011br zam\u011bstnance dne 04.09.2025, kdy je zam\u011bstnavatel povinen vyplatit zam\u011bstnanci n\u00e1hradu mzdy za obdob\u00ed od 01.09.2025 do 04.09.2025).<\/p>\n\n\n\n<p><strong>Z\u00e1v\u011br<\/strong><\/p>\n\n\n\n<p>Takzvan\u00e1 flexi novela z\u00e1kon\u00edku pr\u00e1ce p\u0159in\u00e1\u0161\u00ed \u0159adu v\u00fdznamn\u00fdch zm\u011bn v pracovn\u011bpr\u00e1vn\u00edch vztaz\u00edch. Podrobn\u011bj\u0161\u00ed v\u00fdklad auto\u0159i v\u011bnuj\u00ed kl\u00ed\u010dov\u00fdm zm\u011bn\u00e1m v b\u011bhu a d\u00e9lce v\u00fdpov\u011bdn\u00ed doby, kdy nov\u011b tato doba b\u011b\u017e\u00ed ji\u017e ode dne doru\u010den\u00ed v\u00fdpov\u011bdi druh\u00e9 stran\u011b a rovn\u011b\u017e doch\u00e1z\u00ed ke zkr\u00e1cen\u00ed v\u00fdpov\u011bdn\u00ed doby u vybran\u00fdch v\u00fdpov\u011bdn\u00edch d\u016fvod\u016f. V n\u00e1vaznosti na v\u00fd\u0161e uveden\u00e9 zm\u011bny je nutn\u00e9, aby si zam\u011bstnavatel\u00e9 n\u00e1le\u017eit\u011b uv\u011bdomili dopad t\u011bchto zm\u011bn do praxe a n\u00e1le\u017eit\u011b je reflektovali p\u0159i rozvazov\u00e1n\u00ed pracovn\u00edho pom\u011bru se zam\u011bstnanci.
