Intuitivn\u00ed ch\u00e1p\u00e1n\u00ed slovn\u00edho spojen\u00ed \u201ep\u0159eveden\u00ed na jinou pr\u00e1ci\u201c p\u0159itom sv\u011bd\u010d\u00ed pro z\u00e1v\u011br, \u017ee se jim mysl\u00ed p\u0159eveden\u00ed <strong>\u201ena jinou pozici\u201c, tedy jednostrann\u00e1 zm\u011bna druhu pr\u00e1ce<\/strong> zam\u011bstnance sjednan\u00e9ho v&nbsp;pracovn\u00ed smlouv\u011b. Tento v\u00fdznam ostatn\u011b p\u0159\u00edmo potvrzuje <strong>\u00a7 41 odst. 3 z\u00e1kon\u00edku pr\u00e1ce<\/strong>, podle kter\u00e9ho zam\u011bstnavatel m\u016f\u017ee v&nbsp;p\u0159\u00edpad\u011b pot\u0159eby, tj. jestli\u017ee neposta\u010d\u00ed pouh\u00e1 zm\u011bna pracovn\u00ed n\u00e1pln\u011b, <strong>p\u0159ev\u00e9st zam\u011bstnance <em>\u201ei na pr\u00e1ci jin\u00e9ho druhu, ne\u017e byl sjedn\u00e1n v pracovn\u00ed smlouv\u011b, a to i kdyby s t\u00edm zam\u011bstnanec nesouhlasil.\u201c<\/em><\/strong><\/p>\n\n\n\n<p>Pokud v\u0161ak pohl\u00e9dneme na komentovanou \u00fapravu \u201eo\u010dima\u201c posledn\u00ed judikatury Nejvy\u0161\u0161\u00edho soudu, a zejm\u00e9na pak jeho <strong>n\u00e1vrhu na zru\u0161en\u00ed \u00a7 41 odst. 3 z\u00e1kon\u00edku pr\u00e1ce<\/strong>, kter\u00fd byl pod\u00e1n \u00dastavn\u00edmu soudu v&nbsp;\u0159\u00edjnu 2024, ukazuje se, \u017ee v\u00fdznam pojmu \u201ep\u0159eveden\u00ed na jinou pr\u00e1ci\u201c <strong>m\u016f\u017ee b\u00fdt ve v\u00fdsledku dosti odli\u0161n\u00fd od jeho z\u00e1konn\u00e9ho uchopen\u00ed<\/strong>. Objevuj\u00ed se toti\u017e d\u016fvodn\u00e1 podez\u0159en\u00ed, \u017ee <strong>pravidlo umo\u017e\u0148uj\u00edc\u00ed jednostrannou zm\u011bnu druhu pr\u00e1ce proti v\u016fli zam\u011bstnance odporuje \u00fastavn\u00edmu po\u0159\u00e1dku<\/strong>, konkr\u00e9tn\u011b <strong>z\u00e1kazu nucen\u00e9 pr\u00e1ce<\/strong> a&nbsp;pr\u00e1vu na svobodnou volbu povol\u00e1n\u00ed dle \u010dl. 9 a 26 Listiny z\u00e1kladn\u00edch pr\u00e1v a svobod, o co\u017e tak\u00e9 Nejvy\u0161\u0161\u00ed soud op\u00edr\u00e1 zm\u00edn\u011bn\u00fd n\u00e1vrh.<\/p>\n\n\n\n<p>Zam\u011bstnavatel\u00e9 by tedy m\u011bli v p\u0159\u00edpad\u011b nast\u00e1n\u00ed d\u016fvod\u016f vy\u017eaduj\u00edc\u00edch p\u0159eveden\u00ed zam\u011bstnanc\u016f na jinou pr\u00e1ci a p\u0159i n\u00e1sledn\u00fdch postupech <strong>zachovat zv\u00fd\u0161enou m\u00edru opatrnosti<\/strong>. Spol\u00e9h\u00e1n\u00ed na jednozna\u010dn\u00e9 zn\u011bn\u00ed textu z\u00e1kona a p\u0159ehl\u00ed\u017een\u00ed zna\u010dn\u011b mnohotv\u00e1rn\u011bj\u0161\u00edho soudn\u00edho v\u00fdkladu toti\u017e m\u016f\u017ee zp\u016fsobit z\u00e1sadn\u00ed nep\u0159\u00edjemnosti, obzvl\u00e1\u0161t\u011b v&nbsp;p\u0159\u00edpadech, kdy zam\u011bstnanec s&nbsp;v\u00fdkonem nov\u00e9 pr\u00e1ce nesouhlas\u00ed.<\/p>\n\n\n\n<p>P\u0159esto\u017ee zat\u00edm nen\u00ed z\u0159ejm\u00e9, zda \u00dastavn\u00ed soud vyhov\u00ed n\u00e1vrhu Nejvy\u0161\u0161\u00edho soudu, nebo nikoliv, ani kdy toto rozhodnut\u00ed padne, zam\u011bstnavatel\u016fm lze ji\u017e nyn\u00ed doporu\u010dit, aby z\u00e1konnou \u00fapravu obsa\u017eenou v \u00a7 41 z\u00e1kon\u00edku pr\u00e1ce <strong>nevn\u00edmali striktn\u011b jako p\u0159\u00edkaz k&nbsp;jednostrann\u00e9 zm\u011bn\u011b zam\u011bstnancova druhu pr\u00e1ce bez ohledu na jeho v\u016fli, ale sp\u00ed\u0161e jako tzv. nab\u00eddkovou povinnost<\/strong>. Jestli\u017ee tedy nastane z\u00e1konn\u00fd d\u016fvod pro p\u0159eveden\u00ed (zejm\u00e9na dle \u00a7 41 odst. 1 z\u00e1kon\u00edku pr\u00e1ce) a pokud neposta\u010d\u00ed pouh\u00e1 zm\u011bna pracovn\u00ed n\u00e1pln\u011b zam\u011bstnance v&nbsp;r\u00e1mci pracovn\u00ed smlouvy, m\u011bl by zam\u011bstnavatel <strong>nab\u00eddnou zam\u011bstnanci mo\u017enost v\u00fdkonu jin\u00e9 vhodn\u00e9 pr\u00e1ce, pokud m\u00e1 takovou prac\u00ed v r\u00e1mci sv\u00e9 organiza\u010dn\u00ed struktury k&nbsp;dispozici.<\/strong><\/p>\n\n\n\n<p>N\u00e1sledn\u00fd postup pak bude <strong>z\u00e1viset na postoji zam\u011bstnance<\/strong> \u2013 jestli\u017ee bude souhlasit, pak by m\u011blo n\u00e1sledovat uzav\u0159en\u00ed dohody o zm\u011bn\u011b druhu pr\u00e1ce sjednan\u00e9ho v&nbsp;pracovn\u00ed smlouv\u011b, p\u0159\u00edpadn\u011b p\u0159eveden\u00ed zam\u011bstnance na jinou pr\u00e1ci ve smyslu \u00a7 41 z\u00e1kon\u00edku pr\u00e1ce, ov\u0161em se souhlasem zam\u011bstnance, vyj\u00e1d\u0159en\u00fdm ide\u00e1ln\u011b v&nbsp;p\u00edsemn\u00e9 form\u011b, a to nejenom k&nbsp;p\u0159eveden\u00ed samotn\u00e9mu, ale i k&nbsp;dob\u011b jeho trv\u00e1n\u00ed.<\/p>\n\n\n\n<p>Pokud naopak zam\u011bstnanec souhlasit nebude, <strong>nem\u011bl by jej zam\u011bstnavatel k v\u00fdkonu jin\u00e9 pr\u00e1ce nutit<\/strong>, a u\u017e v\u016fbec ne jej za odm\u00edt\u00e1n\u00ed pln\u011bn\u00ed nov\u00fdch \u00fakol\u016f sankcionovat. Zejm\u00e9na by zam\u011bstnavatel nem\u011bl na odm\u00edtav\u00fd postoj zam\u011bstnance reagovat rozv\u00e1z\u00e1n\u00edm pracovn\u00edho pom\u011bru v\u00fdpov\u011bd\u00ed \u010di okam\u017eit\u00fdm zru\u0161en\u00edm pro poru\u0161en\u00ed povinnost\u00ed. Pokud toti\u017e zam\u011bstnanec takov\u00e9 rozv\u00e1z\u00e1n\u00ed napadne u soudu, bude m\u00edt ji\u017e nyn\u00ed pom\u011brn\u011b zna\u010dnou \u0161anci na \u00fasp\u011bch, kter\u00e1 samoz\u0159ejm\u011b je\u0161t\u011b rapidn\u011b vzroste, pokud \u00dastavn\u00ed soud posoud\u00ed \u00a7 41 odst. 3 z\u00e1kon\u00edku pr\u00e1ce jako proti\u00fastavn\u00ed.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b nesouhlasu zam\u011bstnance s p\u0159eveden\u00edm je naopak t\u0159eba dosp\u011bt k z\u00e1v\u011bru, \u017ee ke zm\u011bn\u011b druhu pr\u00e1ce nedo\u0161lo a \u017ee je t\u0159eba situaci \u0159e\u0161it jin\u00fdm zp\u016fsobem v z\u00e1vislosti na povaze nastal\u00e9ho d\u016fvodu pro p\u0159eveden\u00ed \u2013 rozv\u00e1z\u00e1n\u00edm pracovn\u00edho pom\u011bru dohodou \u010di v\u00fdpov\u011bdi dle \u00a7 52 p\u00edsm. d) z\u00e1kon\u00edku pr\u00e1ce, aktivac\u00ed p\u0159ek\u00e1\u017eky v pr\u00e1ci aj.<\/p>\n\n\n\n<p><strong>Zdravotn\u00ed d\u016fvody pro p\u0159eveden\u00ed a v\u00fdpov\u011b\u010f dle flexinovely z\u00e1kon\u00edku pr\u00e1ce<\/strong><\/p>\n\n\n\n<p>Nadto je aktu\u00e1ln\u011b t\u0159eba zohlednit tak\u00e9 tzv. flexibiln\u00ed novelu z\u00e1kon\u00edku pr\u00e1ce, kter\u00e1 nabyla \u00fa\u010dinnosti k&nbsp;1. 6. 2025 a zavedla tak\u00e9 <strong>podstatn\u00e9 zm\u011bny v \u00faprav\u011b odstupn\u00e9ho \u010di v&nbsp;regulaci zdravotn\u00edch d\u016fvod\u016f pro p\u0159eveden\u00ed zam\u011bstnanc\u016f na jinou pr\u00e1ci a rozv\u00e1z\u00e1n\u00ed jejich pracovn\u00edch pom\u011br\u016f.<\/strong><\/p>\n\n\n\n<p>Podstatn\u00e9 je zejm\u00e9na <strong>v\u011bt\u0161inov\u00e9 slou\u010den\u00ed tzv. \u201ezdravotn\u00edch d\u016fvod\u016f\u201c pro v\u00fdpov\u011b\u010f z&nbsp;pracovn\u00edho pom\u011bru a pro p\u0159eveden\u00ed na jinou pr\u00e1ci<\/strong>, kdy nov\u011b \u00a7 52 p\u00edsm. d) a \u00a7 41 odst. 1 p\u00edsm. a) <strong>nerozli\u0161uje <\/strong>dan\u00e9 d\u016fvody podle toho, zda zam\u011bstnanec pozbyl zdravotn\u00ed zp\u016fsobilost k&nbsp;v\u00fdkonu pr\u00e1ce pro pracovn\u00ed \u00faraz \u010di nemoc z&nbsp;povol\u00e1n\u00ed, nebo pro tzv. \u201eobecn\u00e9 onemocn\u011bn\u00ed\u201c.&nbsp;<\/p>\n\n\n\n<p>Z\u00e1sadn\u00ed souvisej\u00edc\u00ed novinkou je tak\u00e9 <strong>nahrazen\u00ed 12m\u011bs\u00ed\u010dn\u00edho odstupn\u00e9ho dle \u00a7 67 odst. 2 z\u00e1kon\u00edku pr\u00e1ce<\/strong>, kter\u00e9 n\u00e1le\u017eelo zam\u011bstnanci p\u0159i rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru dle dosavadn\u00edho \u00a7 52 p\u00edsm. d) z\u00e1kon\u00edku pr\u00e1ce p\u0159i pozbyt\u00ed zdravotn\u00ed zp\u016fsobilosti zam\u011bstnance pro pracovn\u00ed \u00faraz, nemoc z&nbsp;povol\u00e1n\u00ed \u010di ohro\u017een\u00ed touto nemoc\u00ed, <strong>jednor\u00e1zovou n\u00e1hradou dle \u00a7 271ca z\u00e1kon\u00edku pr\u00e1ce.<\/strong><\/p>\n\n\n\n<p>Zam\u011bstnavatel\u00e9 zejm\u00e9na ocen\u00ed, \u017ee je tato nov\u00e1 n\u00e1hrada <strong>kryt\u00e1 z\u00e1konn\u00fdm poji\u0161t\u011bn\u00edm odpov\u011bdnosti zam\u011bstnavatele za \u00fajmu zp\u016fsobenou pracovn\u00edm \u00farazem \u010di nemoc\u00ed z&nbsp;povol\u00e1n\u00ed<\/strong>. Je tedy spolu s&nbsp;n\u00e1hradou bolestn\u00e9ho, ztr\u00e1ty na v\u00fdd\u011blku atd. hrazena poji\u0161\u0165ovnou, a nikoliv \u201ez kapsy zam\u011bstnavatele\u201c, jak tomu bylo doposud u odstupn\u00e9ho.
