Nov\u011b mus\u00ed b\u00fdt <strong>v&nbsp;DPP<\/strong> <strong>vymezeny tak\u00e9 sjednan\u00e9 pr\u00e1ce (druhov\u011b nebo v\u00fd\u010dtem)<\/strong>. &nbsp;<strong>Na vztahy z&nbsp;DPP a DP\u010c se nov\u011b pou\u017eije (v z\u00e1kon\u00edku pr\u00e1ce):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>cel\u00e1 pr\u00e1vn\u00ed \u00faprava pracovn\u00ed doby a dob odpo\u010dinku<\/strong>;<\/li>\n\n\n\n<li><strong>cel\u00e1 pr\u00e1vn\u00ed \u00faprava p\u0159ek\u00e1\u017eek v&nbsp;pr\u00e1ci na stran\u011b zam\u011bstnance<\/strong>;<\/li>\n\n\n\n<li><strong>pr\u00e1vn\u00ed \u00faprava<\/strong> <strong>n\u00e1hradn\u00edho volna \u010di p\u0159\u00edplatku za pr\u00e1ci ve sv\u00e1tek, p\u0159\u00edplatku za no\u010dn\u00ed pr\u00e1ci, za pr\u00e1ci ve zt\u00ed\u017een\u00e9m pracovn\u00edm prost\u0159ed\u00ed a za pr\u00e1ci o sobot\u00e1ch a ned\u011bl\u00edch<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Novela tak\u00e9 zav\u00e1d\u00ed pr\u00e1vo zam\u011bstnance, aby mu na jeho \u017e\u00e1dost zam\u011bstnavatel <strong>p\u00edsemn\u00e9 od\u016fvodnil svou v\u00fdpov\u011b\u010f vztahu z DPP \u010di DP\u010c<\/strong>, pokud se zam\u011bstnanec domn\u00edv\u00e1, \u017ee byl vztah rozv\u00e1z\u00e1n zam\u011bstnavatelem proto, \u017ee se zam\u011bstnanec dom\u00e1hal vymezen\u00fdch z\u00e1konn\u00fdch pr\u00e1v (nap\u0159. na informace, na rozvr\u017een\u00ed pracovn\u00ed doby atd.).<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b, \u017ee pr\u00e1vn\u00ed vztahy zam\u011bstnance z&nbsp;DPP \u010di DP\u010c u zam\u011bstnavatele trvaly v&nbsp;posledn\u00edch 12 m\u011bs\u00edc\u00edch dohromady alespo\u0148 180 dn\u016f, m\u00e1 zam\u011bstnanec pr\u00e1vo p\u00edsemn\u011b po\u017e\u00e1dat zam\u011bstnavatele o zam\u011bstn\u00e1n\u00ed v&nbsp;pracovn\u00edm pom\u011bru a <strong>zam\u011bstnavatel m\u00e1 nov\u011b povinnost na takovou \u017e\u00e1dost poskytnout od\u016fvodn\u011bnou odpov\u011b\u010f<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">Zaveden\u00ed pr\u00e1va zam\u011bstnanc\u016f pracuj\u00edc\u00edch ve vztaz\u00edch z DPP a DP\u010c na dovolenou<\/h2>\n\n\n\n<p>Ve vztaz\u00edch z&nbsp;DPP a DP\u010c bude m\u00edt zam\u011bstnavatel <strong>povinnost<\/strong> <strong>poskytnout zam\u011bstnanc\u016fm dovolenou<\/strong>, a to za obdobn\u00fdch pravidel a v&nbsp;obdobn\u00e9m rozsahu, jako je tomu u zam\u011bstnanc\u016f pracuj\u00edc\u00edch v&nbsp;pracovn\u00edm pom\u011bru. Pro \u00fa\u010dely kalkulace dovolen\u00e9 se pou\u017eije \u201efiktivn\u00ed\u201c t\u00fddenn\u00ed pracovn\u00ed doba v&nbsp;rozsahu 20 hodin. Pr\u00e1vo na dovolenou zam\u011bstnanci vznikne pouze pokud pracovn\u011bpr\u00e1vn\u00ed vztah z&nbsp;DPP \/ DP\u010c trval nep\u0159etr\u017eit\u011b alespo\u0148 4 t\u00fddny (28 kalend\u00e1\u0159n\u00edch dn\u016f) a z\u00e1rove\u0148 zam\u011bstnanec odpracoval alespo\u0148 80 hodin.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">Regulace pr\u00e1ce na d\u00e1lku a n\u00e1hrad n\u00e1klad\u016f v\u00fdkonu t\u00e9to pr\u00e1ce (pravidla pro tzv. home office)<\/h2>\n\n\n\n<p><strong>V\u00fdkon pr\u00e1ce na d\u00e1lku je dle novely<\/strong> <strong>obecn\u011b mo\u017en\u00fd<\/strong> <strong>jen na z\u00e1klad\u011b<\/strong> <strong>p\u00edsemn\u00e9<\/strong> <strong>dohody zam\u011bstnavatele a zam\u011bstnance<\/strong>. Z\u00e1vazek z&nbsp;t\u00e9to dohody je pak mo\u017en\u00e9 rozv\u00e1zat p\u00edsemnou dohodou \u010di vypov\u011bd\u00ed bez uveden\u00ed d\u016fvodu s&nbsp;15denn\u00ed v\u00fdpov\u011bdn\u00ed dobou (mo\u017eno zkr\u00e1tit \u010di prodlou\u017eit) \u2013 po uplynut\u00ed v\u00fdpov\u011bdn\u00ed doby se obnovuje povinnost zam\u011bstnavatele p\u0159id\u011blovat zam\u011bstnanci pr\u00e1ci na pracovi\u0161ti zam\u011bstnavatele. <strong>Lze tak\u00e9 sjednat tzv. nevypov\u011bditelnost dohody<\/strong>, tedy \u017ee z\u00e1vazek z dohody o v\u00fdkonu pr\u00e1ce na d\u00e1lku nem\u016f\u017ee ani jedna ze smluvn\u00edch stran vypov\u011bd\u011bt (tzn. faktick\u00fd \u201epermanentn\u00ed\u201c home office).<\/p>\n\n\n\n<p>Novela rovn\u011b\u017e zav\u00e1d\u00ed novou<strong> regulaci hrazen\u00ed n\u00e1klad\u016f vznikl\u00fdch ve spojitosti s v\u00fdkonem pr\u00e1ce na d\u00e1lku<\/strong>. Z\u00e1kon pak p\u0159ipou\u0161t\u00ed tyto mo\u017en\u00e9 varianty \u0159e\u0161en\u00ed \u00fahrady n\u00e1klad\u016f:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>n\u00e1klady budou hrazeny v&nbsp;<strong>zam\u011bstnancem prok\u00e1zan\u00e9 v\u00fd\u0161i<\/strong>;<\/li>\n\n\n\n<li>n\u00e1klady budou hrazeny <strong>ve v\u00fd\u0161i pau\u0161\u00e1ln\u00ed \u010d\u00e1stky<\/strong> stanoven\u00e9 dle pravidel z\u00e1kona, kter\u00e1 zahrnuje n\u00e1hradu ve\u0161ker\u00fdch n\u00e1klad\u016f, kter\u00e9 zam\u011bstnanci p\u0159i v\u00fdkonu pr\u00e1ce na d\u00e1lku vznikly (dle n\u00e1vrhu vyhl\u00e1\u0161ky by m\u011bla pau\u0161\u00e1ln\u00ed n\u00e1hrada \u010dinit 4,60 K\u010d na hodinu);<\/li>\n\n\n\n<li>zam\u011bstnanec \u010di zam\u011bstnavatel se mohou p\u0159edem dohodnout <strong>na \u010d\u00e1ste\u010dn\u00e9m \u010di \u00fapln\u00e9m vylou\u010den\u00ed poskytov\u00e1n\u00ed n\u00e1hrad p\u0159i pr\u00e1ci na d\u00e1lku<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Zam\u011bstnavatel\u00e9 ve mzdov\u00e9 sf\u00e9\u0159e (tzn. \u201esoukrom\u00ed\u201c zam\u011bstnavatel\u00e9) mohou poskytovat zam\u011bstnanc\u016fm tak\u00e9 vy\u0161\u0161\u00ed pau\u0161\u00e1ln\u00ed \u010d\u00e1stku, ov\u0161em rozd\u00edl mezi stanovenou a poskytnutou pau\u0161\u00e1ln\u00ed \u010d\u00e1stkou bude dan\u011bn\u00fdm p\u0159\u00edjmem zam\u011bstnance (a nikoliv n\u00e1hradou n\u00e1klad\u016f).<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">Zm\u011bny doru\u010dov\u00e1n\u00ed a elektronick\u00e9ho uzav\u00edr\u00e1n\u00ed smluv<\/h2>\n\n\n\n<p><strong>Zp\u0159\u00edsn\u011bn\u00fdm re\u017eim doru\u010dov\u00e1n\u00ed (\u201edo vlastn\u00edch rukou\u201c) se t\u00fdk\u00e1<\/strong> nov\u011b pouze v\u00fdpov\u011bdi, okam\u017eit\u00e9ho zru\u0161en\u00ed, zru\u0161en\u00ed ve zku\u0161ebn\u00ed dob\u011b a dal\u0161\u00edch p\u00edsemnost\u00ed t\u00fdkaj\u00edc\u00edch se skon\u010den\u00ed pracovn\u00edho pom\u011bru nebo pr\u00e1vn\u00edch vztah\u016f zalo\u017een\u00fdch DPP \u010di DP\u010c (<strong>vyjma dohody<\/strong> o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru \u010di vztahu z&nbsp;DPP a DP\u010c), odvol\u00e1n\u00ed z pracovn\u00edho m\u00edsta vedouc\u00edho zam\u011bstnance nebo vzd\u00e1n\u00ed se tohoto m\u00edsta, mzdov\u00e9ho v\u00fdm\u011bru a platov\u00e9ho v\u00fdm\u011bru.<\/p>\n\n\n\n<p>Z\u00e1rove\u0148 je novelou zav\u00e1d\u011bno <strong>opr\u00e1vn\u011bn\u00ed zam\u011bstnance odstoupit od pracovn\u00ed smlouvy, DPP, DP\u010c nebo jejich zm\u011bny<\/strong> v p\u0159\u00edpad\u011b, \u017ee byly <strong>uzav\u0159eny prost\u0159ednictv\u00edm s\u00edt\u011b nebo slu\u017eby elektronick\u00fdch komunikac\u00ed<\/strong> (nap\u0159. prost\u0159ednictv\u00edm e-mail\u016f).<\/p>\n\n\n\n<p>Podstatn\u00e1 zm\u011bna se t\u00fdk\u00e1 tak\u00e9 <strong>z\u00e1konem dan\u00e9 posloupnosti zp\u016fsob\u016f doru\u010dov\u00e1n\u00ed<\/strong>, kdy nov\u011b<strong>&nbsp;osobn\u00ed doru\u010dov\u00e1n\u00ed p\u00edsemnosti na pracovi\u0161ti<\/strong> <strong>zam\u011bstnavatele<\/strong> (dosud bezv\u00fdjime\u010dn\u011b na prvn\u00edm m\u00edst\u011b) <strong>m\u00e1 stejnou v\u00e1hu jako<\/strong> <strong>elektronick\u00e9 doru\u010dov\u00e1n\u00ed<\/strong> (prost\u0159ednictv\u00edm s\u00edt\u011b nebo slu\u017eby elektronick\u00fdch komunikac\u00ed nebo datovou schr\u00e1nkou) a <strong>osobn\u00ed doru\u010dov\u00e1n\u00ed na jin\u00e9m m\u00edst\u011b<\/strong>.<\/p>\n\n\n\n<p>Novela d\u00e1le <strong>zjednodu\u0161uje podm\u00ednky doru\u010dov\u00e1n\u00ed p\u00edsemnost\u00ed prost\u0159ednictv\u00edm s\u00edt\u011b nebo slu\u017eby elektronick\u00fdch komunikac\u00ed <\/strong>(e-mail atd.), kdy nov\u011b nebude nutn\u00e9, aby takto doru\u010den\u00e1 p\u00edsemnost byla podeps\u00e1na uzn\u00e1van\u00fdm elektronick\u00fdm podpisem <a>zam\u011bstnance<\/a>. Do vlastn\u00edch rukou zam\u011bstnance lze t\u00edmto zp\u016fsobem p\u00edsemnosti doru\u010dovat st\u00e1le jen za podm\u00ednky, \u017ee k&nbsp;tomu zam\u011bstnanec ud\u011blil souhlas, a to nov\u011b v samostatn\u00e9m p\u00edsemn\u00e9m prohl\u00e1\u0161en\u00ed. Zm\u011bny se dotkly tak\u00e9 <strong>pravidel pro doru\u010dov\u00e1n\u00ed p\u00edsemnost\u00ed prost\u0159ednictv\u00edm syst\u00e9mu datov\u00fdch schr\u00e1nek<\/strong>, pro jeho\u017e vyu\u017eit\u00ed <strong>ji\u017e nen\u00ed vy\u017eadov\u00e1n souhlas druh\u00e9 strany<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">Roz\u0161\u00ed\u0159en\u00ed pr\u00e1v pe\u010duj\u00edc\u00edch osob<\/h2>\n\n\n\n<p>Novela zav\u00e1d\u00ed d\u00edl\u010d\u00ed roz\u0161\u00ed\u0159en\u00ed pr\u00e1v t\u011bhotn\u00fdch zam\u011bstnanky\u0148, zam\u011bstnanc\u016f pe\u010duj\u00edc\u00edch o d\u011bti do 15 let a zam\u011bstnanc\u016f, kte\u0159\u00ed p\u0159ev\u00e1\u017en\u011b sami pe\u010duj\u00ed o osoby z\u00e1visl\u00e9 na p\u00e9\u010di ve stupn\u00edch II. a\u017e IV. Nov\u011b je zam\u011bstnavatel <strong>v&nbsp;p\u0159\u00edpad\u011b nevyhov\u011bn\u00ed \u017e\u00e1dosti o \u00fapravu pracovn\u00ed doby t\u011bchto zam\u011bstnanc\u016f povinen zam\u011bstnanci toto zam\u00edtav\u00e9 rozhodnut\u00ed p\u00edsemn\u011b od\u016fvodnit<\/strong>.<\/p>\n\n\n\n<p>V\u00fd\u0161e vymezen\u00ed zam\u011bstnanci (u pe\u010duj\u00edc\u00edch o d\u011bti <strong>v\u0161ak se sn\u00ed\u017eenou&nbsp;v\u011bkovou hranic\u00ed do 9 let<\/strong>) mohou nov\u011b p\u00edsemn\u011b \u017e\u00e1dat zam\u011bstnavatele tak\u00e9 <strong>o v\u00fdkon pr\u00e1ce na d\u00e1lku<\/strong>. Pro&nbsp;p\u0159\u00edpad nevyhov\u011bn\u00ed se <strong>op\u011bt uplatn\u00ed povinnost poskytnout zam\u011bstnanci p\u00edsemn\u00e9 od\u016fvodn\u011bn\u00ed<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">\u00daprava pod\u00e1v\u00e1n\u00ed \u017e\u00e1dost\u00ed o rodi\u010dovskou dovolenou<\/h2>\n\n\n\n<p>S&nbsp;p\u00e9\u010di o d\u011bti souvis\u00ed tak\u00e9 d\u00edl\u010d\u00ed zm\u011bna pod\u00e1v\u00e1n\u00ed \u017e\u00e1dost\u00ed o \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9. Tuto \u017e\u00e1dost musej\u00ed zam\u011bstnanci nov\u011b <strong>pod\u00e1vat p\u00edsemn\u011b<\/strong>, a to <strong>alespo\u0148 30 dn\u016f p\u0159ed n\u00e1stupem na rodi\u010dovskou dovolenou<\/strong>, nebr\u00e1n\u00ed-li tomu v\u00e1\u017en\u00e9 d\u016fvody na stran\u011b zam\u011bstnance. \u017d\u00e1dost p\u0159itom <strong>mus\u00ed obsahovat tak\u00e9 dobu trv\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9<\/strong> \u017e\u00e1dost lze i nad\u00e1le pod\u00e1vat opakovan\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#0e3b85\">Roz\u0161\u00ed\u0159en\u00ed a \u00faprava informa\u010dn\u00edch povinnost\u00ed<\/h2>\n\n\n\n<p>Doch\u00e1z\u00ed k <strong>roz\u0161\u00ed\u0159en\u00ed rozsahu informa\u010dn\u00ed povinnosti zam\u011bstnavatele<\/strong> <strong>ohledn\u011b obsahu pracovn\u00edho pom\u011bru<\/strong> a na <strong>zkr\u00e1cen\u00ed lh\u016fty <\/strong>pro toto informov\u00e1n\u00ed <strong>ze st\u00e1vaj\u00edc\u00edho&nbsp;1 m\u011bs\u00edce od vzniku pracovn\u00edho pom\u011bru na 7 dn\u00ed<\/strong>. Nov\u011b dan\u00e1 povinnost v&nbsp;obdobn\u00e9m rozsahu plat\u00ed i v\u016f\u010di \u201edohod\u00e1\u0159\u016fm\u201c. V p\u0159\u00edpad\u011b informov\u00e1n\u00ed v elektronick\u00e9 podob\u011b m\u00e1 b\u00fdt informace zam\u011bstnanci p\u0159\u00edstupn\u00e1 a zam\u011bstnanec m\u00e1 m\u00edt mo\u017enost ji ulo\u017eit nebo vytisknout.<\/p>\n\n\n\n<p>Mimo ji\u017e nyn\u00ed sd\u011blovan\u00e9 \u00fadaje je zam\u011bstnavatel <strong>povinen informovat zam\u011bstnance<\/strong> o<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>dob\u011b trv\u00e1n\u00ed a podm\u00ednk\u00e1ch zku\u0161ebn\u00ed doby<\/strong>, je-li sjedn\u00e1na,<\/li>\n\n\n\n<li><strong>postupu<\/strong>, kter\u00fd je zam\u011bstnavatel a zam\u011bstnanec povinen dodr\u017eet p\u0159i <strong>rozvazov\u00e1n\u00ed pracovn\u00edho pom\u011bru<\/strong>, a to v\u010detn\u011b \u00fadaje o b\u011bhu a d\u00e9lce v\u00fdpov\u011bdn\u00ed doby,<\/li>\n\n\n\n<li><strong>odborn\u00e9m rozvoji<\/strong>, pokud jej zam\u011bstnavatel zabezpe\u010duje,<\/li>\n\n\n\n<li><strong>stanoven\u00e9 t\u00fddenn\u00ed pracovn\u00ed dob\u011b<\/strong>, <strong>zp\u016fsobu rozvr\u017een\u00ed pracovn\u00ed doby <\/strong>a o <strong>rozsahu pr\u00e1ce p\u0159es\u010das<\/strong>,<\/li>\n\n\n\n<li>rozsahu <strong>minim\u00e1ln\u00edho nep\u0159etr\u017eit\u00e9ho denn\u00edho odpo\u010dinku<\/strong> a <strong>nep\u0159etr\u017eit\u00e9ho odpo\u010dinku v t\u00fddnu<\/strong> a o poskytov\u00e1n\u00ed <strong>p\u0159est\u00e1vky v pr\u00e1ci na j\u00eddlo a oddech<\/strong> nebo p\u0159im\u011b\u0159en\u00e9 doby na oddech a j\u00eddlo,<\/li>\n\n\n\n<li><strong>org\u00e1nu soci\u00e1ln\u00edho zabezpe\u010den\u00ed<\/strong>, kter\u00e9mu zam\u011bstnavatel <strong>odv\u00e1d\u00ed pojistn\u00e9 na soci\u00e1ln\u00ed zabezpe\u010den\u00ed zam\u011bstnance<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>V\u0161echny nov\u011b po\u017eadovan\u00e9 informace, jako\u017e i n\u011bkter\u00e9 st\u00e1vaj\u00edc\u00ed mohou b\u00fdt nahrazeny odkazem na p\u0159\u00edslu\u0161n\u00fd pr\u00e1vn\u00ed p\u0159edpis, na kolektivn\u00ed smlouvu nebo na vnit\u0159n\u00ed p\u0159edpis.<\/p>\n\n\n\n<p><a id=\"_msocom_1\"><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>N\u00e1sleduj\u00edc\u00ed text je v\u011bnov\u00e1n shrnut\u00ed nejpodstatn\u011bj\u0161\u00edch zm\u011bn pracovn\u011bpr\u00e1vn\u00ed \u00fapravy zav\u00e1d\u011bn\u00fdch novelou z\u00e1kon\u00edku pr\u00e1ce v\u00a0roce 2023, \u00fa\u010dinnou v\u011bt\u0161inov\u011b od 01.10.2023 a \u010d\u00e1ste\u010dn\u011b pak od 01.01.2024 (dovolen\u00e1 u \u201edohod\u00e1\u0159\u016f\u201c).
